CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2001-53 <br />BY: MAYOR MUSIAL <br />AN ORDINANCE AUTHORIZING THE MAYOR OF THE <br />CITY OF NORTH OLMSTED TO ENTER INTO A TWO- <br />YEAR AGREEMENT WITH MOORDOUGH, INC., DBA <br />ANGELINA'S PIZZA, FOR THE PURPOSE OF <br />PROVIDING CONCESSIONS AT THREE CTTY PARKS; <br />AND DECLARING AN EMERGENCY. <br />WHEREAS, the City has solicited offers of proposal for the provision of concession <br />services at three City parks, to-wit: Barton and Bradley Field, Clague Park, and North Olmsted <br />Park; and <br />WHEREAS, Moordough, Inc., dba Angelina's Pizza has submitted the only such offer of <br />proposal to provide concession services at the said parks; and <br />WHEREAS, the Board of Control approved the proposal of this vendor as in accordance <br />with the specifications on file, and the lowest and best proposal received; and <br />WHEREAS, it is the desire of this Council to authorize and direct the Mayor to enter into <br />an agreement with Moordough, Inc., dba Angelina's Pizza, consistent with the proposal made by <br />this Vendor, and approved by the Board of Control; <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: <br />SECTION 1: That the Mayor be and he hereby is authorized to enter into an Agreement <br />with Moordough, Inc. dba Angelina's Pizza to provide concession services to three city parks-- <br />Barton and Bradley Field, Clague Park, and North Olmsted Park, for a two-year period <br />commencing with the date of the execution of said Agreement. Said Agreement shall be in <br />substantially the form of the Agreement, attached to this Ordinance and marked as Exhibit "A." <br />SECTION 2: That all Ordinances, and parts of Ordinances, inconsistent or in conflict <br />with this Ordinance, be, to the extent of any such inconsistency or conflict, repealed. <br />SECTION 3: That this Ordinance is hereby declared to be an emergency measure <br />immediately necessary for the preservation of the public health, safety and welfare and for the <br />further reason that the spring park season is about to begin and the City must immediately <br />authorize the Mayor to enter into this Agreement so that park concession services will be <br />available to the public this summer, and, provided that it receives the affirmative vote of two- <br />thirds of all members of Council, it shall take effect and be in force immediately upon its passage <br />and approval by the Mayor.
