CITY OF NORTH OLMSTED PARK CONCESSION AGREEMENT THIS AGREEMENT is made on this day of l?- >-?-?--'?--, 2001 at North Olmsted, Ohio, by and between the City of North Olmstc00 Dover Center Road, North Olmsted, Ohio 44070 (hereinafter, "the City") and Moordough, Inc., dba Angelina's Pizza, 30594 Lorain Road, North Olmsted, Ohio 44070 (hereinafter, "Vendor"). WHEREAS, the City has solicited proposals for the provision of concession services at three City parks, to-wit: Barton and Bradley Field, Clague Park, and North Olmsted Parlc; and WHEREAS, Vendor has submitted a proposal to provide concession services at the said parks; and WHEREAS, the City believes that the Vendor's proposal is the best submitted and best provides for the needs of the general public; and WHEREAS, the Board of Control has approved the Vendor's approval as the lowest and best proposal received; and WHEREAS, the City and the Vendor desire to enter into an agreement providing for the City to grant permission to the Vendor to enter onto and furnish concession services at its said City Parks, and for the Vendor to furnish concession services at said City parks on the terms and conditions which follow; and WHEREAS, the City Council has enacted Ordinance No. 2001-_57-3, authorizing the Mayor of the City of North Olmsted to enter into an Agreement with the Vendor on the terms and conditions which follow herein; NOW, THEREFORE, intending to be legally bound, and mutually acknowledging the sufficiency of the consideration for this Agreement, the City and the Vendor agree as follows: ARTICLE ONE. CONTRACT SERVICES Nature of Services 1.01 The City and Vendor agree that Vendor shall provide park concessions to Barton and Bradley Field, Clague Park, and the North Olmsted Park, as described in the request for proposals attached hereto and made a part of this Agreement as Exhibit A, and the proposal
