CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2001-49 <br />BY: MAYOR MUSIAL <br />AN ORDINANCE AUTHORIZING THE MAYOR TO ENTER INTO A CONTRACT <br />FOR THE PURCHASE OF PROPERTY LOCATED AT 27375 LORAIN ROAD, NORTH <br />OLMSTED, OHIO FOR THE PLIRPOSE OF CARRYING OUT THE INTENT OF THE <br />VOTERS OF THE CITY OF NORTH OLMSTED RELATIVE TO THE <br />CONSTRUCTION OFA NEWLIBRARYAND DECLARING AN EMERGENCY. <br />WHEREAS, the voters of the City of North Olmsted on November 7, 2000 passed a bond <br />issue for the purpose of acquiring property and constructing a new Library; and <br />WHEREAS, this Couucil heretofore authorized and directed the Director of Law of the City <br />of North Olmsted, to negotiate for the acquisition of all property necessary for the construction of <br />said Library; and <br />WHEREAS, the Director of Law has consistent with the order of Council to do the same, <br />successfully negotiated a contract with Z Properties, L.L.C., an Ohio Limited Liability Company, <br />a copy of which is attached hereto and marked Exhibit "A". <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: <br />SECTION 1: That the Mayor be and he is hereby authorized and directed to enter into an <br />Agreement in the substantial form as that which is attached hereto and made a part hereof and marked <br />Exbibit "A" with Z Properties, L.L.C., an Ohio Limited Liability Company for the acquisition of <br />property located at 27375 Lorain Road, North Olmsted, Ohio. <br />SECTION 2: This Ordinance is hereby declared to be an emergency measure necessary <br />for the immediate preservation of the public peace, properry, health, safery and welfare within the <br />City for the further reason it is immediately necessary to acquire property so that plans for the <br />coordination of construction can commence and further provided it receives the affirmative vote <br />of two-thirds of all members of Council, this Ordinance shall take effect and be in force <br />immediately upon its passage by the Council and approval by the Mayor; otherwise it shall take <br />effect and be in force after the earliest period allowed by law.
