CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2001-46 <br />BY: COUNCII. MEMBER KASLER <br />AN ORDINANCE CREATING NEW SECTION 111.02 OF CHAPTER I11 OF THE <br />CITY ADMINISTRATNE CODE, ENTITLED "MANDATORY MINIMDM <br />CONTRACTING STANDARDS RELATING TO BIDDER RESPONSIBILITY" WHICH <br />PROVIDES FOR THE ESTABLISHMENT OF MINIMUM CONTRACTING <br />RESFONSIBILITY STANDARDS TO BE IMFOSED UPON ALL BIDDERS ON CITY <br />CONTRACTS INVOLVING IMPROVEMENTS TO REAL PROPERTY. <br />WHEREAS, municipalities are at risk of being exposed to incompetent contractors who <br />deliver poor quality products over budget and behind schedule; and <br />WHEREAS, this Council does not want to use contractors who expose their employees to <br />safety ar health hazards, unlawfully discriminate against their employees, or fail to provide health care <br />coverage to their employees; and <br />WHEREAS, this Council wants to encourage responsible employment practices, maximize <br />the use of a local workforce, and support efforts to train a workforce of skilled construction <br />workers; and <br />WHEREAS, the foregoing legitimate government concerns arise most often in the bidding <br />and performance of government contracts, involving improvements to government-owned real <br />property, including, but not limited to public streets and rights-of-way, and public buildings; and <br />WHEREAS, it is the desire of this Council to accordingly empower the Directors <br />authorized to let bids for public improvements to real property in the City of North Olmsted to <br />establish stringent responsible contracting standards prior to letting contracts; <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: <br />SECTION 1: That there be and hereby is established new Section 111.02 of the City <br />Administrative Code, entitled "Mandatory Minunum Contracting Standards Relating to Bidder <br />Responsibility" which, as established, shall read as foflows:
