Re-executed, August 10, 2001, original lost. <br />CITY OF NORTH OLM5TED <br />ORDINANCE NO. 2001-43 <br />BY: MAYOR MUSIAL <br />AN ORDINANCE AUTHORIZING THE MAYOR TO ENTER INTO A CONTRACT <br />FOR THE PURCHASE OF PROPERTY LOCA TED AT 27418 BUTTERNUT RIDGE <br />ROAD, NORTH OLMSTED, OHIO FOR THE PURPOSE OF CARRYING OUT THE <br />INTENT OF THE VOTERS OF THE CITY OF NORTH OLMSTED RELATIVE TO <br />THE CONSTRUCTION OF A NEW LIBRARY AND DECLARING AN <br />EMERGENCY. <br />WHEREAS, the voters of the City of North Olmsted on November 7, 2000 passed a bond <br />issue for the purpose of acquiring property and constructing a new Library; and <br />WHEREAS, this Council heretofore authorized and directed the Director of Law of the <br />City of North Olmsted, to negotiate for the acquisition of all property necessary for the <br />construction of said Library; and <br />WHEREAS, the Director of Law has consistent with the order of Council to do the same, <br />successfully negotiated a contract with Peter J. Canepa and Kristen M. Canepa, a copy of which <br />is attached hereto and marked Exhibit "A". <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: <br />SECTION 1: That the Mayor be and he is hereby authorized and directed to enter into <br />an Agreement in the substantial form as that which is attached hereto and made a part hereof and <br />marked Exhibit "A" with Peter J. Canepa and Kristen M. Canepa for the acquisition of property <br />located at 27418 Butternut Ridge Road, North Olmsted, Ohio. <br />SECTION 2: This Ordinance is hereby declared to be an emergency measure necessary <br />for the immediate preservation of the public peace, property, health, safety and welfare within <br />the City for the further reason it is immediately necessary to acquire property so that plans for <br />the coordination of construction can commence and further provided it receives the affirmative <br />vote of two-thirds of all members of Council, this Ordinance shall take effect and be in force <br />immediately upon its passage by the Council and approval by the Mayor; otherwise it shall take <br />effect and be in force after the earliest period allowed by law.
