<br />CITY OF NORTH OLMSTED <br />RESOLUTION NO. 2001- 31 <br />BY: COUNCIL MEMBER MILLER <br />A RESOLUTION EXPRESSING SUPPORT FOR THE PASSAGE OF HOUSE BILL <br />ZSI, WHICH WOULD CREATE NEW SECTION 4511.203 OF THE OHIO <br />REVISED CODE, PROHIBITING THE USE OF MOBILE TELEPHONES WHILE <br />OPERATING MOTOR VEHICLES ON THE STREETS, HIGHWAYS, OR ANY <br />PUBLIC OR PRWATE PROPERTY OPEN FOR VEHICULAR TRAVEL OR <br />PARKING, IN THE STATE OF OHIO, AND DECLARING AN EMERGENCY. <br />WHEREAS, the Ohio General Assembly has before it for consideration House Bill 251, <br />which would generally prohibit the use of mobile telephones by motorists traveling on streets, <br />highways, or other public or private places open for vehicular travel or parking in the State of <br />Ohio; and <br />WHEREAS, this Council recently extensively reviewed the traffic safety issues associated <br />with the use by motorists of mobile telephones while traveling on roads and highways, and found <br />the evidence that the use of mobile telephones in motor vehicles created unique traffic safety <br />hazards to be compelling; and <br />WHEREAS, this Council recently adopted Ordinance No. 2000-117, which prohibits the <br />use by motorists of mobile telephones while operating motor vehicles on the roads and streets of <br />North Olmsted; and <br />WHEREAS, Ordinance No. 2000-117 contains a sunset provision and will terminate of its <br />own accord, if Council does not legislatively act otherwise prior thereto, on or about January 23, <br />2002; and <br />WHEREAS, this Council wishes to express to the State Legislature its support for House <br />Bill 251; <br />NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OffiO: <br />SECTION 1: That the Council of the City of North Olmsted hereby resolves to endorse, <br />support and work for the passage of House Bill 251, beginning by mailing a copy of this <br />Resolution of Support to Governor Taft, to State Senator Spada, and to State Rep. Conway <br />Kilbane.
