CHAPTER 930: Use of Public Rights of Way <br />scale and in a format specified by the City Engineer, and certified to the City as <br />accurately depicting the location of all Facilities constructed pursuant to the permit. <br />(o) Restoration of Improvements: Upon completion of any construction work, the <br />Permit Holder shall promptly repair any and all Public Ways and provide property <br />improvements, fixtures, structures and Facilities which were damaged during the <br />course of construction, restoring the same as nearly as practicable to its condition <br />before the start of construction. <br />(p) Landscape Restoration: <br />(1) All trees, landscaping and grounds removed, damaged or disturbed as a result <br />of the construction, reconstruction, installation, maintenance, repair ar <br />replacement of Facilities must be replaced or restored as nearly as may be <br />practicable, to the condition existing prior to performance of work. <br />(2) All restoration work within the Public Ways shall be done in accordance with <br />landscape plans approved by the Service Director. <br />(q) Construction Surety: Prior to issuance of a construction permit, the Permit Holder <br />shall provide a construction bond, as provided in Section 930.11 ofthis Ordinance. <br />(r) Responsibility of Owner: The owner of the Facilities to be constructed, <br />reconstructed, installed, located, operated, maintained or repaired and, if different, <br />the Permit Holder, are responsible for performance of and compliance with all <br />provisions of this Ordinance. <br />930.13 FEES AND COMPENSATION <br />(a) Purpose: It is the purpose of the Section to provide for the payment and recovery of <br />all direct and indirect costs and expenses of the City related to the enforcement and <br />administration of this Ordinance. <br />(b) Use Permit Fee: Any applicant for a Use Permit pursuant to Section 930.10 of this <br />Ordinance shall pay a non-refundable fee of Five Hundred Dollars ($500.00). This <br />fee is intended to provide for the costs and expenses incurred by the City in <br />connection with the review of information required to be submitted by the applicant <br />for a Use Permit. <br />(c) Other City Costs: All Permit Holders shall, within thirty (30) days after written <br />demand therefor, reimburse the City for all direct and indirect costs and expenses <br />incurred by the City in connection with the management of the Public Ways, not <br />otherwise specified in this Ordinance, including transfer of a Use Permit. <br />(d) Construction Permit Fee and Deposit: <br />(1) Prior to the issuance of a construction permit, the applicant for a construction <br />permit shall pay a permit fee equal to One Hundred Fifty Dollars ($150.00). <br />(2) In addition to the aforementioned construction permit fee, the applicant shall <br />deposit with the City, funds to cover the cost of inspection based on the <br />schedule submitted by the applicant. Said schedule shall be approved or <br />modified by the City Engineer for the purpose of calculating the estimated cost <br />EXHIBIT A
