CHAPTER 930: Use of Public Rights of Way <br />any cable television franchise shall include a provision for an institutional network to <br />provide high-speed transmission of data, voice, and video among and between the <br />City, County, school and library buildings. The institutional network shall include the <br />capacity to transmit information between the institutions serviced by the network and <br />the subscribers to the cable television system. In the event an institutional network <br />has already been provided by another franchisee, or from some other source, the City <br />may negotiate to receive monies, equipment and/or services in place of providing all <br />or part of an institutional network. <br />(e) Cable Television System Capacity: No Cable Television Operator shall build its <br />System beyond the capacity necessary to provide cable television Service or <br />institutional network service without obtaining express permission from the City and <br />securing a Use Permit hereunder for such additional use. The City's permission shall <br />not be unreasonably withheld. <br />(fl Cable Television Fees: In addition to the fees set forth in this Ordinance, cable <br />television franchisees shall be subject to the franchise fees, payments and costs <br />provided in a cable television franchise as required by other ordinances or <br />agreements. <br />930.15 OTHER REMEDIES: <br />Nothing in this Ordinance shall be construed as limiting any judicial remedies that the City may <br />have, at law or in equity, for enforcement of this Ordinance. <br />930.16 SEVERABILITY <br />If any section, subsection, sentence, clause, phrase, or other portion of this Ordinance, or its <br />application to any Person, is, for any reason, declared invalid, in whole or in part by any court or <br />agency of competent jurisdiction, said decision shall not affect the validity of the remaining <br />portions hereof. <br />930.17 VARIANCE <br />A Service Provider or applicant for Service Provider status may apply to City Council for a <br />variance on any provisions of this Ordinance. <br />930.99 PENALTY <br />Whoever violates any provision of this chapter is guilty of a minor misdemeanor. Any such <br />violation shall constitute a separate offense on each successive day continued. <br />EXHIBIT A
