Ordinance No. 2001-08 Page 2 SECTION 1: That the City, upon recommendation of the Director of Public Service, having already awarded a contract to Morton International, Inc. to supply road salt, has determined that said contractor may be unable to meet the City's demand for road salt. Because of the emergency need, the Director of Public Service is authorized to purchase road salt on an emergency basis from other sources, including but not limited to, Acme Company. The authority to purchase from other sources shall be limited to times and situations when Morton International, Inc. is unable to meet the demand of the City during the balance of the year 2001. Upon passage of this ordinance, it will be retroactively effective to January 1, 2001. All purchases of road salt made by the Director of Public Service from January 1, 2001, until the effective date of this Ordinance, on an emergency basis from sources other than Morton International, Inc., are hereby ratified, and the Director of Finance is herebv authorized to pay all invoices presented to her for such emergency purchases, provided that they are properly presented, and further provided that funds are appropriated and available for such expenditure. SECTION 2: That this Ordinance is hereby declared to be an emergency measure necessary for the preservation of the public health, safety and welfare, and for the further reason that it is immediately necessary to protect the residents, and further provided it receives the affirmative vote of two-thirds of all members of Council, it shall take effect and be in force immediately upon its passage and approval by the Mayor. ,--? , PASSED: ?T- AT?EST: -? , Barbara L.
