Ordinance No. 2001-08 <br />Page 2 <br />SECTION 1: That the City, upon recommendation of the Director of Public <br />Service, having already awarded a contract to Morton International, Inc. to supply road <br />salt, has determined that said contractor may be unable to meet the City's demand for road <br />salt. Because of the emergency need, the Director of Public Service is authorized to <br />purchase road salt on an emergency basis from other sources, including but not limited to, <br />Acme Company. The authority to purchase from other sources shall be limited to times <br />and situations when Morton International, Inc. is unable to meet the demand of the City <br />during the balance of the year 2001. Upon passage of this ordinance, it will be <br />retroactively effective to January 1, 2001. All purchases of road salt made by the <br />Director of Public Service from January 1, 2001, until the effective date of this <br />Ordinance, on an emergency basis from sources other than Morton International, <br />Inc., are hereby ratified, and the Director of Finance is herebv authorized to pay all <br />invoices presented to her for such emergency purchases, provided that they are <br />properly presented, and further provided that funds are appropriated and available <br />for such expenditure. <br />SECTION 2: That this Ordinance is hereby declared to be an emergency measure <br />necessary for the preservation of the public health, safety and welfare, and for the further <br />reason that it is immediately necessary to protect the residents, and further provided it <br />receives the affirmative vote of two-thirds of all members of Council, it shall <br />take effect and be in force immediately upon its passage and approval by the Mayor. <br />,--? <br />, <br />PASSED: <br />?T- <br />AT?EST: <br />-? , <br />Barbara L.
