Ordinance No. 2001-05 <br />Page 2 <br />CHAPTER 177. COMMUNIT'Y ACCESS. <br />177.01 DEFINITIONS. <br />(a) "City media" means the airspace located approximately 20-25 feet above Lorain <br />Road, approximately mid-way between East Park and West Park Drives, and in the <br />vicinity of a certain CEI wire, or wires, which traverse that airspace above Lorain Road <br />from north to south. <br />(b) "Community event" means any meeting, program, exhibition, assembly, <br />celebration, or other gathering which is either open to the general public or to which at <br />least thirty (30) residents of the City of North Olmsted have been invited or are otherwise <br />permitted to attend. <br />(c) "Community organization" means (a) any non-profit corporation, which is tax <br />exempt pursuant to IRC Section 501(c)(3), or any not for profit unincorporated <br />association, which: (i) either has had a continuous presence in the City of North Olmsted <br />for at least the two year period immediately preceding its application under the provisions <br />of this Chapter, or whose membership is composed of at least thirty (30) persons, with at <br />least seventy-five percent (751/6) of those persons being residents of the City of North <br />Olmsted; and (ii) organizes, sponsors or otherwise supports community events; or (b) any <br />agency of the United States of America, the State of Ohio, or any political subdivision of <br />the State of Ohio. <br />(d) "Presence in the City of North Olmsted" means that the organization has an office <br />in a building which is located in a commercial district of the City <br />177.02 PURPOSE. <br />The regulations in this Chapter are enacted for the following purposes: <br />(a) to make the airspace above the right-of-way described in Section 177.01(a) a <br />nonpublic forum solely to further the limited purposes set forth in this Section 177.02 ; <br />(b) to accommodate access by community organizations to this nonpublic forum only <br />for the purpose of announcing community events; <br />(c) to ensure that the announcements placed in or at this nonpublic forum are of <br />genuine community interest; and <br />(d) to ensure that this nonpublic forum is easily accessible by community <br />organizations; <br />2
