Ordinance No. 2001-05 <br />Page 5 <br />177.07 PRIORIT'Y IN CASES OF CONFLICT; TIME LIMITS <br />(a) Applications for single event announcements shall not be accepted if the event <br />announced occurs more than one (1) year after the time of submission of the application. <br />(b) In cases where multiple applications have been received for simultaneous posting <br />of proposed announcements, the following order of priority shall apply: the first <br />application filed with the City shall have priority over all subsequently filed applications <br />177.08 APPEALS FROM DECISIONS OF MAYOR'S DESIGNEE. <br />(a) Every decision of the Mayor's Administrative Assistant or designee denying an <br />application to announce a community event may be appealed to a Community Access <br />Board consisting of the Mayor, the Director of Public Safety, and the Director of Human <br />Resources. Any such appeal must be in writing and filed with the Mayor's <br />Administrative Assistant or designee within seven (7) work days following the date of the <br />mailing of the decision denying the application. <br />(b) The Community Access Board shall hear the appeal of the applicant, shall permit the <br />applicant to offer evidence in support of its application, and shall render its decision no <br />later than ten (10) work days following the date upon which the appeal was filed. No <br />decision shall be made by the Community Access Board until it has first consulted with <br />the City Director of Law. In reviewing appeals made, the Community Access Board <br />shall uphold the decision of the Mayor's Administrative Assistant only if the Board <br />concludes that either the application or the proposed 'announcement violates at least one <br />provision of this Chapter. Every decision of the community access board shall be <br />considered a final administrative order, subject to further appeal pursuant to the <br />provisions of Chapter 2506 of the Ohio Revised Code. <br />SECTION 2: That any Ordinance, or any part of any Ordinance, inconsistent or in <br />conflict with this Ordinance is, to the extent of any such inconsistency or conflict, hereby <br />repealed. <br />SECTION3: That this Ordinance is hereby declared to be an emergency measure <br />immediately necessary for the preservation of the public health, safety, and welfare of the City of <br />North Olmsted, and for the further reason that it is immediately necessary to enact such <br />legislation to a11ow the public immediate access to that portion of the airspace above a limited <br />portion of the City's right-of-way, which is being made a nonpublic forum; and further provided <br />it receives the affirmative vote of two-thirds of all members of Council, it shall take effect and be <br />in force immediately upon its passage and approval by the Mayor.
