CITY OF NORTH OLMSTED <br />ORDINANCE NO. 97- 71 <br />BY.• Councilwoman Saringer <br />AN ORDINANCE AMENDING SECTIONS 755.11 AND 755.12 <br />OF CHAPTER 755 OF THE BUSINESS REGULATION CODE <br />OF THE CITY OF NORTH OLMSTED, ENTITLED <br />"SECONDHAND DEALERS, " IN ORDER TO FURTHER <br />REGULATE UNATTENDED DONATIONS MADE TO <br />SECONDHAND DEALERS, AND FURTHER CREATING A <br />NEW SECTION 521.1 S OF THE GENERAL OFFENSES <br />CODE OF THE CITY OF NORTH OLMSTED TO PROVIDE <br />MISDEMEANOR PENALTIES AGAINST INDIVIDUALS <br />WHO LEAVE DONATED MATERIALS ON SIDEWALKS, IN <br />PARKING AREAS, OR OTHERWISE OUTSIDE OF <br />BUILDINGS OF SECONDHAND DEALERS. <br />WHEREAS, the Council believes that secondhand dealers who accept charitable <br />donations should not be permitted to use the sidewalks, yard areas, and parking areas to accept <br />such donations and to accumulate donated materials at these locations both during and after <br />business hours; and <br />WHEREAS, the Council further believes that the use of such locations to accept and <br />accumulate donated materials creates "eyesores" in the community, encourages theft, and <br />adversely affects property values; and <br />WHEREAS, the Council believes that these problems can be effectively addressed by <br />amending the existing Chapter 755 of the Business Regulation Code, which regulates secondhand <br />dealers in the City of North Olmsted, and by providing misdemeanor penalties against individuals <br />who leave donated items on sidewalks, in parking areas, and in other locations outside of <br />buildings; <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: <br />SECTION 1: That Sections 755.11 and 755.12 of Chapter 755 of the Business <br />Regulation Code of the City of North Olmsted, entitled "Secondhand Dealers," which presently <br />read as follows: <br />,,,.,, a ~. ~. ... ,r,. ,.;., y, „Ma <br />
