CITY OF NORTH OLMSTED <br />ORDINANCE NO. 97- 68 <br />BY.• Ed Boyle, Mayor <br />AN ORDINANCE APPROVING THE EXECUTION OF AN ENTERPRISE <br />ZONE AGREEMENT BETWEEN THE CITY OF NORTH OLMSTED AND <br />CARGILL CORPORATION, AND DECLARING AN EMERGENCY. <br />WHEREAS, this Council, pursuant to Ordinance No. 92-22, requested the designation of <br />certain territory of the City of North Olmsted, Ohio ("the City") as an Urban Jobs and Enterprise <br />Zone ("the Enterprise Zone"); and <br />WHEREAS, the Board of County Commissioners of the County of Cuyahoga ("the <br />County") adopted a resolution on May 5, 1992, designating such area as an Enterprise Zone <br />pursuant to §§5709.61 to .66, inclusive, of the Ohio Revised Code ("the Act"); and <br />WHEREAS, effective June 8, 1992, the Director of Development of the State of Ohio <br />certified the Enterprise Zone as an Urban Jobs and Enterprise Zone under the Act; and <br />WHEREAS, Cargill Corporation, an Ohio corporation ("the Company"), will submit an <br />application ("the Application") to the County for tax exemption for the Project described in such <br />application; and <br />WHEREAS, the City desires to approve the execution of an Enterprise Zone Agreement <br />("the Agreement"), a copy of which is attached hereto as Exhibit A, among the City, the County, <br />and the Company, in order to induce the Company to undertake the Project at the Project Site, as <br />defined in the Agreement. <br />NOW, THEREFORE, BE IT ORDAINED BY THE CITY OF NORTH OLMSTED, <br />COUNTY OF CUYAHOGA, STATE OF OHIO: <br />SECTION 1: The Mayor of the City is hereby authorized in the name of and on behalf of <br />the City, to execute and deliver the Agreement in substantially the form attached hereto as Exhibit <br />A. The form of the Agreement is approved with changes therein not inconsistent with this <br />Ordinance and not substantially adverse to the City. The approval of those changes as not being <br />substantially adverse to the City shall be conclusively determined by the execution of the <br />Agreement by the Mayor. <br />SECTION 2: The Mayor of the City is further authorized in the name of and on behalf of <br />the City, to negotiate and enter into an agreement with the School Board of the City of North <br />Olmsted, pursuant to Ohio Revised Code §5709.82, providing for compensation to the Board. <br />..,., ~„~~,~,~~n~.a:, . _ ~, .. ,.,: _...,., _,. _. ..,.. <br />
