CITY OF NORTH OLMS~D ORDINANCE NO. 97- BY: Mayor Boyle AN ORDINANCE GRANTING TO THE CLEVELAND ELECTRIC ILLUMINATING COMPANY (CEn A LIMITED RIGHT OF WAY AND EASEMENT WITHIN CERTAIN PROPERTY OWNED BY THE CITY OF NORTH OLMSTED AT CLAGUE PARg, FOR PURPOSES OF PROVIDING F.1.T.f'77?7L' SERVICE T10 THE AT&T MONOPOLE COMPLEX, AND DECLARING AN EMERGENCY. WHEREAS, this Council, on or about May 20, 1997, adopted Ordinance No. 97-41, authorizing the Mayor to enter into an agreement with AT&T Wireless PCS, Inc. , for the purpose of leasing certain land at Clague Pazk to AT&T Wireless to be used for the construction, maintenance and operation of a monopole and related antenna facilities; and WHEREAS, in order to implement said lease, it is necessary that the City grant an easement to CEI on city-owned land at Clague Park so that electrical power may be provided to the monopole and antenna facilities; and WHEREAS, it is the intent of this Council that said easement be granted to CEI not perpetually, but only for such period of time as AT&T Wireless, or its successors or assignees, lease from the City of North Olmsted the land upon which the said monopole and antenna facilities aze to be located; NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: SECTION 1: That the Mayor of the City of North Olmsted be and he is hereby authorized and directed to execute an agreement, substantially in the form of the agreement attached hereto as Exhibit A, granting to the Cleveland Electric Illuminating Company (CEI) an easement solely for the purpose of providing electrical power to the monopole complex which is the subject of the lease between the City of North Olmsted and AT&T Wireless, authorized by North Olmsted Ordinance No. 97-41.
