City of North Olmsted <br />Ordinance No. 97- 57 <br />$Y: councilman O'Grady <br />AN ORDINANCE AMENDING SECTION 1135.02 OF THE ZONING CODE <br />ENTITLED "ACCESSORY USES AND BUII.DINGS" OF CHAPTER 1135 <br />ENTITLED "ONE AND TWO FAMII,Y RESIDENCE DISTRICT" <br />Whereas, this council has reviewed Section 1135.02 (i) of the zoning code dealing with <br />the regulations of the height offences limiting access to swimming pools in residence districts; <br />and <br />Whereas, after reviewing such height regulations in neighboring communities, as well as <br />the National Swimming Pool Institute's Minimum Standards for Residential Pools, it is this <br />council's belief that the present six (6) foot height requirement is unreasonable and unnecessary <br />and thus places an unfair and unreasonable burden upon our residents; and <br />Whereas, it is the belief of this council that a more reasonable regulation would be a <br />height regulation that provides for a minimum of four (4) feet with a maximum of six (6) feet <br />limiting access to residential pools; and <br />Whereas, after careful consideration, the Planning Commission of the City of North <br />Olmsted, on the ~ z .day of 1997, recommended approval of the <br />proposed amendment to Section 113 .02 of the Zoning Code. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: <br />Section 1: That Section 1135.02 of the Zoning Code entitled "Accessory Uses and <br />Buildings" which now reads: <br />1135.02 ACCESSORY USES AND BUII,DINGS. <br />The following accessory uses and buildings are permitted in any One and Two Family <br />Residence District, provided that no accessory building may be erected prior to the construction <br />of the dwelling: <br />(a) Home Professional Office. An office for a professional person residing in the <br />dwelling and employing not more than one nonresident assistant may be permitted <br />in a Residence District, provided: <br />(1) The residential character of the dwelling exterior remains unchanged; <br />(2) Any equipment used therein shall not create any exterior disturbances; <br />(3) The number of motor vehicles attracted to the premises shall not exceed <br />the number normally associated with a single family residence; and <br /> <br />
