CITY OF NORTH OLMSTED <br />ORDINANCE NO. 97-52 <br />BY: Mayor Boyle <br />AN ORDINANCE PROVIDING FOR THE SUBMISSION TO <br />THE ELECTORS OF THE CITY OF NORTH OLMSTED OF <br />AN AMENDMENT TO ARTICLE XI OF THE CHARTER OF <br />THE CITY OF NORTH OLMSTED TO PROVIDE FOR <br />AGGREGATE AND COLLECTIVE BARGAINING FOR <br />CONJUNCTIVE ELECTRIC SERVICE AND OTHER <br />SIMILAR AGGREGATED UTILITY PLANS, AND <br />DECLARING AN EMERGENCYAS AMENDED. <br />WHEREAS, it has come to the attention of Council that the Public Utilities Commission <br />of Ohio has negotiated terms for pilot projects for Conjunctive Electric Service with electricity <br />providers within the State of Ohio; and <br />WHEREAS, such Conjunctive Electric Service allows and provides for collective <br />bargaining between large groups of electrical consumers and an electricity provider to allow for <br />lower electricity rates and consumer costs; and <br />WHEREAS, it is the belief of Council that allowing the City to act as a collective <br />bargaining representative on behalf of some or all of its residents will be beneficial to the welfare <br />and interests of the City; and <br />WHEREAS, the current franchise clause of the Charter of the City of North Olmsted does <br />not provide adequate authority for the City to act as such a representative; and <br />WHEREAS, it is also likely that other utility providers will wish to engage in collective or <br />aggregate bargaining procedures in the future, and the Council wishes to prepare for representing <br />City residents in connection with those utilities as well. <br />BE IT ORDAINED by the Council of the City of North Olmsted, County of Cuyahoga <br />and State of Ohio, two thirds of all members concurring, that: <br />SECTION 1: Pursuant to Article XVIII, Section 9 of the Ohio Constitution and Article <br />XII of the Charter of the City of North Olmsted, the Council authorizes and directs that the <br />following proposal to amend the Charter of the City of North Olmsted be submitted to the <br />electors of the City of North Olmsted at an election to be held at the usual places of voting in the <br />City on November 4, 1997: <br />.....ip~'~.sat'tx4'x.+fi~CF~arcMPTM~.rTYMtV.! ~^'EiNM14dm'~~^';. ~ -.. i....~_ r..<, ~:. ,.:~..,y~.MRPtr 't <br />
