;~ <br />.. <br />is <br />CITY OF NORTH OLMSTED <br />ORDINANCE N0.97-41 <br />By: Mayor Boyle <br />AN ORDINANCE AUTHORIZING THE MAYOR OF THE CITY OF NORTH <br />OLMSTED TO ENTER INTO A LEASE AGREEMENT WITH AT&T WIRELESS <br />COMMUNICATIONS FOR LAND ON WHICH TO PLACE A MONOPOLE <br />ANTENNA, SURROUNDING COMPLEX, FENCING, LAND SOAPING AND <br />RELATED EQUIPMENT AT A DESIGNATED AREA OF CLAGUE PARK. <br />Whereas, the Mayor has recommended that AT&T Wireless be granted a lease <br />for designated property at Clague Park. <br />Whereas, upon the recommendation of the Mayor, this Council does hereby <br />express its desire to have the Mayor enter into this lease agreement with said firm for and <br />on behalf of the City. <br />NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATEOF OHIO: <br />Section 1: That the Mayor be and he is hereby authorized and directed to enter <br />into a lease agreement with AT & T Wireless for use of land on which to place the above <br />mentioned equipment. A copy of said agreement is attached hereto and made a part <br />hereof and marked Exhibit "A". <br />Section 2: That this Ordinance is hereby declared to be an emergency measure <br />immediately necessary for the preservation of the public health, safety and welfare, and <br />for the reason that it is immediately necessary to proceed with the engineering services <br />for this project and further provided it receives the affirmative vote oftwo-thirds of all <br />members of Council, it shall take effect and be in force immediately upon its passage and <br />approval by the Mayor. <br />
