CITY OF NORTH OLMSTED ORDINANCE NO. 97 - 23 BY: Councilman Norman T. Musial AN ORDINANCE ACCEPTING AN EASEMENT FOR THE INSTALLATION AND MAINTENANCE OF A WATER LINE FOR THE PURPOSE OF SUPPLYING WATER SERVICE BY THE CITY OF CLEVELAND TO LAND OWNED BY HENNIE HOMES, INC. AND DECLARING AN EMERGENCY. WHEREAS, Hennie Homes, Inc. desires to extend a water main into their property for the Cinnamon Woods Development, and WHEREAS, the City of Cleveland requires that extension of water lines shall only be approved if easements are granted to both the City of Cleveland and the City of North Olmsted in order that water mains maybe constructed and maintained therein, and WHEREAS, this Council deems it in the best interest of the City to accept the water main easement described herein; attached Exhibit "A". NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: SECTION 1: That this Council does hereby accepts an easement from Hennie Homes, Inc. for the installation and maintenance of a water main for the purpose of supplying water service by the City of Cleveland, to the property of Hennie Homes, Inc. SECTION 2: That the Clerk of Council is hereby authorized to forward a certified copy of this Ordinance to the Director of Public Utilities of the City of Cleveland. SECTION 3: That it is found and determined that all formal actions of this Council concerning and relating to the adoption of this Ordinance were adopted in an open meeting of this Council, and that all deliberations of this Council, and its committees that resulted in such formal action, were in meetings open to the public in compliance with all legal requirements, including Section 121.22 of the Ohio revised Code. SECTION 4: That this Ordinance is hereby declared to be an emergency measure immediately necessary for the preservation of the public health, safety and welfare, and further provide it receives the affirmative vote oftwo-thirds of all members of Council, it shall take effect and be in force immediately upon its passage and approval by the Mayor.
