CITY OF NORTH OLMSTED <br />ORDINANCE NO. 97 - 23 <br />BY: Councilman Norman T. Musial <br />AN ORDINANCE ACCEPTING AN EASEMENT FOR THE INSTALLATION <br />AND MAINTENANCE OF A WATER LINE FOR THE PURPOSE OF <br />SUPPLYING WATER SERVICE BY THE CITY OF CLEVELAND TO LAND <br />OWNED BY HENNIE HOMES, INC. AND DECLARING AN EMERGENCY. <br />WHEREAS, Hennie Homes, Inc. desires to extend a water main into their <br />property for the Cinnamon Woods Development, and <br />WHEREAS, the City of Cleveland requires that extension of water lines shall <br />only be approved if easements are granted to both the City of Cleveland and the City of <br />North Olmsted in order that water mains maybe constructed and maintained therein, and <br />WHEREAS, this Council deems it in the best interest of the City to accept the <br />water main easement described herein; attached Exhibit "A". <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY <br />OF NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: <br />SECTION 1: That this Council does hereby accepts an easement from Hennie <br />Homes, Inc. for the installation and maintenance of a water main for the purpose of <br />supplying water service by the City of Cleveland, to the property of Hennie Homes, Inc. <br />SECTION 2: That the Clerk of Council is hereby authorized to forward a <br />certified copy of this Ordinance to the Director of Public Utilities of the City of Cleveland. <br />SECTION 3: That it is found and determined that all formal actions of this <br />Council concerning and relating to the adoption of this Ordinance were adopted in an <br />open meeting of this Council, and that all deliberations of this Council, and its committees <br />that resulted in such formal action, were in meetings open to the public in compliance with <br />all legal requirements, including Section 121.22 of the Ohio revised Code. <br />SECTION 4: That this Ordinance is hereby declared to be an emergency measure <br />immediately necessary for the preservation of the public health, safety and welfare, and <br />further provide it receives the affirmative vote oftwo-thirds of all members of Council, it <br />shall take effect and be in force immediately upon its passage and approval by the Mayor. <br />
