i <br />CITY OF NORTH OLMSTED <br />ORDINANCE N0.97-14 <br />BY: Councilman Duane Limpert <br />AN ORDINANCE ACCEPTING A TRAFFIC CONTROL EQUIPMENT <br />EASEMENT LOCATED ON PROPERTY OWNED BY SERVICE STATION <br />HOLDINGS, INC. AND DESIGNATED AS PERMANENT PARCEL N0.234-20- <br />07 BY CUYAHOGA COUNTY MAPS AND RECORDS, SAID EASEMENT <br />SHOWN ON EXHIBIT "A" AND AS DESCRIBED ON EXHIBIT "B" AND <br />DECLARING AN EMERGENCY. <br />WHEREAS, the City of North Olmsted and the Ohio Department of Transportation have <br />agreed to pay all costs and expense for the construction of the traffic control equipment <br />within the easement area as shown on the Exhibit "C", being part of the City-Wide <br />"Closed Loop" Traffic Signal System Project. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: <br />SECTION 1: That the City hereby accepts an easement from Service Station Holdings, <br />Inc. for traffic control equipment, as shown on Exhibit "C". <br />SECTION 2: That the Engineer of the City of North Olmsted is hereby directed to <br />cause said easement to be recorded in the office of the Cuyahoga County Recorder. <br />SECTION 3: That this Ordinance is hereby determined to be an emergency measure <br />necessary for the immediate preservation of the public peace, property, health and safety <br />of the City, and further provided it receives the affirmative vote oftwo-thirds of all <br />members of Council, it shall take effect and be in force immediately upon its passage and <br />approval by the Mayor. <br /> <br />
