CITY OF NORTH OLMSTED <br />ORDINANCE NO. 97-2 <br />BY: Mayor Boyle <br />AN ORDINANCE AMENDING SECTION 555.03 ENTITLED "SPECIFIC <br />PROHIBITIONS" OF CHAPTER 555 ENTITLED "NOISE CONTROL" OF <br />THE CODIFIED ORDINANCES OF THE CITY OF NORTH OLMSTED AND <br />DECLARING AN EMERGENCY. <br />WHEREAS: It is the desire of this Council to allow companies under contract <br />with the City for waste collection to perform that work in a timely and efficient manner; <br />and, <br />WHEREAS: It is the desire of this Council to include language in said chapter <br />which would exempt companies under contract with the City for waste collection from <br />abiding by the hours designated for general loading and unloading in Section 555.03 (f). <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY <br />OF NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO. <br />SECTION 1: That Section 555.03 of the Codified Ordinances of the City of <br />North Olmsted entitled "Specific Prohibitions" which currently reads: <br />555.03 SPECIFIC PROHIBITIONS <br />The following acts, and the causing or permitting thereof, are declared to be in <br />violation of this chapter: <br />(a) Animals and Birds. Owning, possessing or harboring any animal <br />or bird which frequently or for continued duration, howls, barks, meows, <br />squawks, or makes other sounds which create a noise disturbance across a <br />residential real property boundary. <br />(b) Places of Public Entertainment. Operating, playing or permitting the <br />operation or playing of any radio, television, phonograph, drum, musical <br />instrument, sound amplifier or similar device which produces, reproduces, <br />or amplifies sound in any place of public entertainment at a sound level <br />greater than ninety-five dBA as read by the slow response on a sound level <br />meter at any point that is normally occupied by a customer, unless a <br />conspicuous and legible sign is located outside such place, near each <br />public entrance, stating "WARNING: SOUND LEVELS WITHIN MAY <br />CAUSE PER.1!rIANENT HEARING IlVIPAIRMENT". <br />(c) Vehicle or Motorboat Repairs and Testing. Repairing, rebuilding, <br />modifying or testing any motor vehicle, motorcycle, or motorboat in such <br /> <br />
