<br />CITY OF NORTH OLMSTED <br />ORDINANCE NO. 98-149 <br />BY: The Mayor and Entire City Council <br />ORDINANCE TO EXPRESS THE NEED AND DESIRE OF THE CITY OF <br />NORTH OLMSTED, OHIO TO ESTABLISH THE COMMUNITY DIVERSION <br />PROGRAM FOR THE CITY OF NORTH OLMSTED AND FOR THE <br />APPOINTMENT OF VOLUNTEER MAGISTRATES TO PRESIDE AT PROGRAM <br />HEARINGS AND DECLARING AN EMERGENCY <br />WHEREAS, the City of North Olmsted, Ohio is within the jurisdiction of the <br />Cuyahoga County Court of Common Pleas: Juvenile Division (Court), which <br />pursuant to R.C. 2151.23(A)(1) has exclusive original jurisdiction concerning any <br />child who is charged in a complaint to be a delinquent or unruly child; and <br />WHEREAS, one hundred eighty-five (185) delinquency and unruly complaints <br />were filed with the Court in 1996 from the City of North Olmsted and this number <br />increased to two hundred and thirty-eight (238) in 1997; and <br />WHEREAS, only twenty-six (26) cases were diverted from the Court in 1996 <br />and thirty-seven (37) in 1997 and many cases filed in Court may have involved <br />juveniles who may have committed first time misdemeanor or status offenses for <br />which diversion may have been appropriate; and <br />WHEREAS, the Community Diversion Program (CDP) is a program sponsored <br />by the Court in cooperation with the City of North Olmsted featuring Volunteer <br />Magistrates selected by the City of North Olmsted Youth Development Program <br />Diversion Committee and trained by the Court; <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: <br />Section 1: That the City of North Olmsted, Ohio has a need for and <br />desire for participation in the Community Diversion Program (CDP) sponsored <br />by the Cuyahoga County Juvenile Court. <br />Section 2: That the City of North Olmsted, Ohio has a need for and <br />desire for Votunteer Juvenile Court Magistrates to be appointed by the <br />Cuyahoga County Juvenile Court. <br />Section 3: That these Volunteer Magistrates shall hear and pronounce <br />disposition on all complaints involving minor first time delinquency and unruly <br />
