?:. <br />CITY OF NORTH OLMSTED <br />ORDINANCE NO. 98-148 <br />BY: COUNCILPERSONS DUANE LIMPERT & MICHAEL GAREAU JR. <br />AN ORDINANCE AMENDING SECTION 721.03 OF CHAPTER 721 OF THE B USINESS <br />REGULATION CODE, ENTITLED "PEDDLERS, SOLICITORS AND CAIWASSERS, " SO <br />AS TO PROHIBIT PEDDLING, SOLICITING AND CANVASSING IN THE CITY AFTER <br />SIINSET, AND DECLARING AN EMERGENCY, AS AMENDED. <br />WHEREAS, present Section 721.03(c) of Chapter 721 of the Business Regulation Code <br />limits peddling, soliciting and canvassing in the City to the days of Monday through Saturday, and <br />between the hours of 9:00 am and 8:00 pm on those days; and <br />WHEREAS, during certain times of the year, darkness comes to North Olmsted prior to 8:00 <br />pm; and <br />WHEREAS, this Council believes that the health and safety of residents are threatened, and <br />crimes may more easily be facilitated, by persons peddling, soliciting and canvassing in the City after <br />dark; and <br />WHEREAS, this Council further believes that limiting peddling, soliciting and canvassing to <br />daylight hours will not deleteriously affect the business interests and First Amendment rights of law <br />abiding peddlers, solicitors or canvassers; <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: <br />SECTION 1: That Section 721.03 of Chapter 721 of the Business Regulation Code, which <br />presently reads as follows: <br />"721.03 SALES ON PRIVATE PROPERTY. <br />(a) License or Reg,istration Required. <br />(1) No peddler or solicitor shall peddle or solicit within the City, uriless he or she <br />is the holder of a valid license issued pursuant to this Chapter. <br />(2) No canvasser shall obtain or seek to obtain or influence the opinions of the <br />residents of the City until he or she is registered pursuant to this Chapter. <br />(b) Application: Fee; License; Registration. <br />(1) Any person seeking a license in conformity with this chapter shall obtain an <br />application for same from the Office of the Director of Public Safety and shall <br />submit the completed application, along with the appropriate fee, to such <br />office, on a form supplied by the Director which shall contain the following <br />information: <br />A. Full name of the applicant. <br />.,
