CITY OF NORTH OLMSTED ORDINANCE NO. 98 -139 BY.• MAYOR MUSIAL AN ORDINANCE AMENDING SECTION 171.06 OF CHAPTER 171 OF THE ADMINISTRATIVE CODE, ENTITLED "COMMUNITY REINVESTMENT, " IN ORDER TO PROVIDE A NEW PROCEDURE AND A NEW FEE SCHEDULE FOR THE REVIEW OF TAX EXEMPTION APPLICATIONS, AND DECLARING AN EMERGENCY. WHEREAS, Chapter 171 of the Administrative Code provides a process for property owners in the City to apply to the City for tax exemption within Community Reinvestment Areas of the City established pursuant to R.C. Section 3735.66; and WHEREAS, this Council desires to amend Section 171.06 of said Chapter 171 to make some changes and clarifications in the procedure for reviewing such applications, and further to establish a new fee schedule which is more consistent with state law, all in order to encourage, through the use of such tax exemptions, more quality commercial and industrial businesses to either move into the City or, if already present in the City, to expand their present business locations in the City; and WHEREAS, this Council specifically states that it does not intend, by enacting the following amendments to Section 171.06, to in any way convert its pre-1994 Community Reinvestment Area into a post-1994 Community Reinvestment Area, in accordance with this CRA distinction recognized in SB 19, eff. 7-22-94; NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: SECTION ONE: That Section 171.06 of Chapter 171 of the Administrative Code, entitled "Applications for Exemption; Procedure," which presently reads: ° 171.06 APPLICATIONS FOR EXEMPTION; PROCEDURE. (A) Every application for exemption from real property taxation shall be made to the Housing Officer who sha11 immed.iately forward such application to the Housing Council for its review, analysis and recommendation to the Mayor.
