CITY OF NORTH OLMSTED <br />ORDINANCE NO. 98-113 <br />BY: MAYOR NORMAN MUSIAL <br />AN ORDINANCE CREATIIVG NEW SECTION 505.16 OF CHAPTER SOS OF THE <br />GENERAL OFFENSES CODE ENTITLED "ANIMALS & FOWL, " IN ORDER TO <br />REGULATE THE KEEPING AND MAINTAINING OF VICIOUS AND DANGEROUS <br />ANIMALS WITHIN THE CITY OF NORTH OLMSTED, AND DECLARING AN <br />EMERGENCY, AS AMENDED. <br />WHEREAS, the keeping of vicious and dangerous animals by residents constitutes a serious <br />threat to the health and safety of the community; and <br />WHEREAS, it is the desire of this Council to regulate the keeping and maintaining of such <br />animals by residents in the City of North Olmsted, and to criminalize certain wrongful conduct <br />by keepers of vicious and dangerous animals; <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE C7TY OF <br />NORTH OLMSTED, CDUNTY OF CUYAHOGA AND STATE OF OHIO: <br />SECTIONI: That there be and hereby is created new Section 505.16 of Chapter 505 of the <br />General Offenses Code. Said new section shall be entitled and in its entirety shall read as follows: <br />"505.16 VICIOUS AND DANGEROUS ANIMALS. <br />(a) D ' i n. The following definitions shall apply in the interpretation and enforcement <br />of this section: <br />(1) "Animal Warden" means the Animal Warden of the City or his authorized <br />representative. <br />(2) "Vicious animal" means any animal which represents a danger to any person(s), <br />or to any other domestic animal, for any of the following reasons: <br />A. Any animal that kills or causes serious physical harm (as defined in <br />Ohio R.C. 2901.01(E) to any person or domestic animal. <br />B. Any animal which bites or causes physical harm to any person or <br />domestic animal while off the premises of the owner on more than one <br />occasion. <br />C. Any dog that is classified as vicious under Ohio R.C. <br />955.11(A)(4)(a)(iii). <br />D. Any wolf-hybrid. <br />E. Vicious animal does not include a police dog that has inflicted any harm <br />?
