...:::..::t <br />c. on more than one occasion, leaves feces on residential property. <br />(d) Any person violating any of the prohibitions of this section shall be deemed guilty <br />of a minor misdemeanor for the first offense. For the second and subsequent violations of this <br />section, the violator sha11 be deemed guilty of a misdemeanor of the fourth degree. In addition, <br />the court may order, at the violator's expense, that the wild animal be transfened to an <br />appropriate zoological or similar facility. If this is not practical, as an alternative, the court may <br />order, again at the violator's expense, that the wild animal be humanely destroyed by a qualified <br />veterinarian. <br />SECTION 2: That any ordinance or parts of any ordinance in conflict or inconsistent with <br />any provision of this Ordinance are, to the extent of any such conflict or inconsistency, repealed. <br />SECTION 3. That this legislation is hereby declared to be an emergency measure <br />immediately necessary for the preservation of the public health, safety and welfare, and for the <br />further reason that it is immediately necessary to enact such legislation to provide for the <br />prohibition of the keeping and maintaining of certain wild animals which pose an immediate threat <br />to the health and safety of residents of this community, and further provided it receives the <br />affirmative vote of two-thirds of a11 members of council, it shall take effect and be in force <br />immediately upon its passage by Council and approval by the Mayor. <br />-? <br />J. <br />PASSED: <br />ATIEST.• <br />BARBARA L.
