T <br />CITY OF NORTH OLMSTED <br />ORDINANCE NO. 98- 111 <br />By: COUNCILMAN GEORGE NASHAR <br />AN ORDINANCE AMENDING SECTIONS 1139.01 AND 1145.03 OF THE <br />ZONING CODE OF THE C1TY OF NORTH OLMSTED, TO CHANGE THE <br />CONDIITONS UNDER WHICH ANIMAL HOSPITALS AND PET SHOPS <br />ARE PERMITTED USES WTrHIN THE GENERAL RETAIL BUSINESS <br />DISTRICT OF THE CITY, AND PROVIDING FOR DOG AND CAT <br />KENNELS TO BECOME PERMITTED USES WITHIN THE LIMITED <br />INDUSTRY-INDUSTRIAL PARK DISTRICT OF THE CITY. <br />WHERF..4.S, this Council believes that the location of animal hospitals, pet shops, and kennels <br />near residences in the City ofNorth Olmsted, by virtue of the animal noise and odor generated, poses <br />a threat to the health and welfare of nearby residents; and <br />WHEREAS, this Council desires to amend the City Zoning Code so as to change the <br />circumstances under which animal hospitals and pet shops may be permitted uses within the City's <br />General Retail Business District, and to provide that animal kennels, heretofore not permitted in any <br />district of the City, become a pernutted use within the City's Limited Industry-Industrial Park District; <br />and <br />WHERF..9.S, this Council accordingly desires to amend Sections 1139.01 and 1145.03 of the <br />Zoning Code to effect these changes; and <br />WHEREAS, after careful onsideration, the Planning Commission of the City of North <br />Olmsted, on the J ? day of 1998 recommended approval of the proposed <br />amendments to Sections 1139.01 and 1145.03 of the Zoning Code of the City of North Olmsted. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLM5TED, COUNTY OF CUYAHOGA AND STATE OF OHIO: <br />SECTION 1: That Section 1139.01 of the Zoning Code, which presently reads as follows: <br />"1139.01 GENERAL RETAIL BUSINESS DISTRICT. <br />(a) Intent. For the purposes of the Zoning Code, General Retail Business Districts axe <br />hereby established to meet the shopping, convenience and service needs of the residents of the entire <br />community. <br />
