CITY OF NORTH OLM5TED ORDINANCE NO. 98-109 By: Councilman Michael R. Gareau, Jr. AN ORDINANCE ACCEPTING FOR DEDICATION AS PART OF THE RIGHT-OF-WAY ALONG MILL ROAD CERTAIN PROPERTY OWNED BY VARIOU5 ADJACENT OWNERS, AND VACATING OTHER CURRENT MILL ROAD RIGHT-OF-WAY, AND DECLARING AN EMERGENCY. WHEREAS, certain adjacent property owners have conveyed to the City of North Olmsted property along Mill Road in connection with the Mill Road improvement project; and WHEREAS, it is the desire of the City of North Olmsted to accept said property, as noted on the attached Exhibits A, B, C, D, E, F, for the right-of-way purposes; and WHEREAS, it is the desire of the City of North Olmsted to Vacate another strip of existing Mill Road right-of-way no longer required for roadway purposes, and as noted on attached Exhibit A. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: SECTION 1: That the City of North Olmsted hereby accepts for Dedication for right-of-way purposes along Mill Road the land owned by various adjacent owners and described as the shaded area of the Mill Road Dedication Plats attached hereto as Exhibits A, B, C, D, E, F, and incorporated herein by reference. SECTION 2: That the City of North Olmsted hereby Vacates for right-of-way purposes a strip of existing Mill Road right-of-way, as noted on attached Exhibit A. SECTION 3: That this Ordinance is hereby declared to be an emergency measure immediately necessary for the preservation of the public health, safety and welfare, and for the further reason that it is immediately necessary to accept said land for right-of-way purposes, and to vacate other said land for right-of-way purposes, as noted on attached Exhibit A, B, C, D, E, F, so that the acceptance of the Mill Road improvement project can proceed, and further provided that it receives an affirmative vote of two-thirds of all members of Council, it shall take effect and be in force immediately upon its passage and approval by the Mayor.
