CITY OF NORTH OLM5TED <br />ORDINANCE NO. 98-109 <br />By: Councilman Michael R. Gareau, Jr. <br />AN ORDINANCE ACCEPTING FOR DEDICATION AS <br />PART OF THE RIGHT-OF-WAY ALONG MILL ROAD <br />CERTAIN PROPERTY OWNED BY VARIOU5 ADJACENT <br />OWNERS, AND VACATING OTHER CURRENT MILL ROAD <br />RIGHT-OF-WAY, AND DECLARING AN EMERGENCY. <br />WHEREAS, certain adjacent property owners have conveyed to the City <br />of North Olmsted property along Mill Road in connection with the Mill Road <br />improvement project; and <br />WHEREAS, it is the desire of the City of North Olmsted to accept said property, <br />as noted on the attached Exhibits A, B, C, D, E, F, for the right-of-way purposes; and <br />WHEREAS, it is the desire of the City of North Olmsted to Vacate another <br />strip of existing Mill Road right-of-way no longer required for roadway purposes, and <br />as noted on attached Exhibit A. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE <br />CITY OF NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF <br />OHIO: <br />SECTION 1: That the City of North Olmsted hereby accepts for Dedication for <br />right-of-way purposes along Mill Road the land owned by various adjacent owners and <br />described as the shaded area of the Mill Road Dedication Plats attached hereto as Exhibits <br />A, B, C, D, E, F, and incorporated herein by reference. <br />SECTION 2: That the City of North Olmsted hereby Vacates for right-of-way <br />purposes a strip of existing Mill Road right-of-way, as noted on attached Exhibit A. <br />SECTION 3: That this Ordinance is hereby declared to be an emergency measure <br />immediately necessary for the preservation of the public health, safety and welfare, and for <br />the further reason that it is immediately necessary to accept said land for right-of-way <br />purposes, and to vacate other said land for right-of-way purposes, as noted on attached <br />Exhibit A, B, C, D, E, F, so that the acceptance of the Mill Road improvement project can <br />proceed, and further provided that it receives an affirmative vote of two-thirds of all <br />members of Council, it shall take effect and be in force immediately upon its passage and <br />approval by the Mayor. <br />
