<br />assigns, until the completion and City acceptance of said storm sewers at which time the <br />temporary construction easement becomes null and void. The said Grantor themselves, <br />and their successors and assigns, hereby covenant with the said Grantee, its successors <br />and assigns, that they are the lawful owners of said premises and have full power to grant, <br />bargain, sell, convey and release the same in the manner aforesaid and will warrant and <br />defend the same against all claims. <br />The said easements are given for the purpose of granting to the Grantee the right <br />to construct, maintain and operate a storm sewer together with the necessary manholes for <br />the transportation of stormwater with the unimpaired access to said sewer and the rights <br />of ingress and egress, on, over and through said land for all purposes necessary and <br />incident to the construction, operation and maintenance and, from time to time, to alter, <br />repair or remove the same. <br />The Grantor hereby restricts said premises within the limits of the above described <br />permanent easement against the construction thereon or above or subjacent thereto any <br />buildings, structures, tunnels, or excavation therein in any manner interfering with said <br />sewers whatsoever, the access thereto, or the maintenance thereof, or otherwise <br />interfering therewith; provided that, notwithstanding the foregoing restrictions and <br />prohibitions Grantor may make any of the uses or do any of the things to the foregoing <br />premises with the express written consent of the Grantee. Such reserved and permitted <br />usage shall include inter atia, landscaping, parking of vehicles within the regulations set <br />forth in the Codified Ordinances, paving, streets, driveways, sidewalks and the <br />maintenance thereof. <br />-2-
