., e . , 4 <br />CITY OF NORTH OLMSTED <br />ORDINANCE NO. 98-99 <br />BY: MAYOR NORMAN MUSIAL <br />AN ORDINANCE ACCEPTING A STORM SEWER EASEMENT LOCATED ON <br />PROPERTY OWNED BY CHARLES H. BURNESON, JR. AND DESIGNATED <br />AS PERMANENT PARCEL NO. 237-21-008 ON THE CUYAHOGA COUNTY <br />MAPS AND RECORDS, IN CONNECTION WITH THE BROOKPARK TO <br />MASTICK ROAD STORM SEWER PROJECT, AND DECLARING AN <br />EMERGENCY. <br />WHEREAS, the City is in the process of improving the City Storm Sewer <br />System by constructing and installing a new storm sewer line from Brookpark to Mastick <br />Roads; and <br />WHEREAS, in order to construct and install said new line, it is necessary that <br />the City obtain easements from several property owners, whose properties lie between <br />Brookpark and Mastick Roads, and west of Clague Road: and <br />WHEREAS, this Council desires to fairly compensate the owner of the property <br />known as Permanent Parcel No. 237-21-008, and obtain from said owner a temporary <br />easement, for storm sewer easement purposes, in order to construct and install now, and <br />in the future, storm sewer line near said property; <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE <br />CITY OF NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF <br />OHIO: <br />SECTION 1: That the Mayor is hereby authorized and directed to accept, on behalf of <br />the City of North Olmsted, a storm sewer easement from Charles H. Burneson, Jr. the <br />owner of certain real property located on Mastick Road, west of Clague Road, and known <br />as Permanent Parcel No. 237-21-008. A copy of said Easement, which the Mayor is <br />authorized and directed to accept on behalf of the City, is attached hereto as Exhibit C, <br />and made a part hereof as though fully rewritten herein.
