. ??. <br />CITY OF NORTH OLMSTED <br />ORDINANCE NO. 98-97 <br />BY: MAYOR NORMAN MUSIAL <br />AN ORDINANCE ACCEPTING A STORMAND SANITARY SEWER <br />EASEMENT LOCATED ONPROPERTY OWNED BY ROBERT E. <br />GILCHRIST, CLARA MAE MALLOY AND DELBERTA STROM, <br />AND DESIGNATED AS PERMANENT PARCEL NO. 237-21-007 <br />ON THE CUYAHOGA COUNTY MAPS AND RECORDS, IN <br />CONNECTION WITH THE BROOKPARK TO MASTICK ROAD <br />STORM SEWER PROJECT, AND DECLARING ANEMERGENCY. <br />WHEREAS, the City is in the process of improving the City Storm Sewer System by <br />constructing and installing a new storm sewer line from Brookpark to Mastick Roads; and <br />WHEREAS, in order to construct and install said new line, it is necessary that the City obtain <br />easements from several property owners, whose properties lie between Brookpark and Mastick <br />Roads, and west of Clague Road; and <br />WHEREAS, this Council desires to fairly compensate the owners of the property known as <br />Permanent Parcel No. 237-21-007, and obtain from said owners a permanent and temporary <br />easement, for storm and sanitary sewer easement purposes, in order to construct and install now, and <br />in the future, storm and sanitary sewer lines across said property; <br />NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: <br />SECTION 1: That the Mayor is hereby authorized and directed to accept, on behalf of the City of <br />North Olmsted, a storm and sanitary sewer easement from Robert E. Gilchrist, Clara Mae Malloy and <br />Delberta Strom, the owners of certain real property located on Mastick Road, west of Clague Road, <br />and known as Permanent Parcel No. 237-21-007. A copy of said Easement, which the Mayor is <br />authorized and directed to accept on behalf of the City, is attached hereto as Exhibit A, and made a <br />part hereof as though fully rewritten herein. <br />SECTION 2:. That the Director of Finance is authorized and directed to set aside and pay to the <br />owners of said property, upon execution of the easement document, the sum of three thousand <br />dollars ($3,000.00) as compensation for the granting of said easement.
