u CITY OF NORTH OLMSTED ORDINANCE NO. 98- 94 BY.• COUNCILMAN MICHAEL R. GAREAU, JR. AN ORDINANCE AMENDING SECTION 351.04 OF THE TRAFFIC CODE OF THE CITY OF NORTH OLMSTED SO AS TO PROVIDE INCREASED CRIMINAL PENALTIES FOR UNLAWFUL PARKING AT HANDICAPPED PARKING LOCATIONS ON PUBLIC AND PRIVATE LOTS, AND DECLARING AN EMERGENCY. WHEREAS, by State and local law, special parking locations near commercial and other establishments must be, and are, designed and restricted for the use of handicapped persons in order to facilitate access by such persons to these establishments; and WHEREAS, this Council has become aware that non-handicapped persons, who might best be described as simply lazy, oftentimes park at the designated handicapped parking locations thereby preventing handicapped persons from using these locations; and WHEREAS, it is the belief of this Council that the present minor misdemeanor classification for violations of the City's handicapped parking location ordinance has, unfortunately, not sufficiently deterred these non-handicapped, lazy persons from unlawfully using, to the detriment of the handicapped, these parking locations specially designated only for the use of handicapped persons; and WHEREAS, this Council accordingly wishes to amend Section 351.04 of the Traffic Code in order to provide heightened criminal penalties for violations of the restrictions on the use of handicapped parking locations on public and private properties; NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: SF.C.'TInN L.
