CITY OF NORTH OLMSTED <br />ORDINANCE NO. 98 -81 <br />By: Councilman Michael R. Gareau, Jr. <br />AN ORDINANCE ACCEPTING A 5TORM SEWER EASElVIENT LOCATED ON <br />PROPERTY OWNED BY L. R. & N. J. KEADEY AND DESIGNATED AS <br />PERMANENT PARCEL NO. 232-02-045 CUYAHOGA COUNTY MAPS AND <br />RECORDS SAID EASEMENT SHOWN ON EXHIBIT "A" AND DECLARING <br />AN EMERGENCY. <br />WHEREAS, the City has elected to construct Phase 1 of the Lansing Drive Storm <br />Sewer Improvement, and <br />WHEREAS, L. R. & N. J. Keadey have agreed to give the City of North Olmsted <br />a easement to cover a portion of the Phase 1 work and the existing 54 inch storm sewer, <br />with the new easement area as shown on the plan which is attached to the proposed <br />easement agreement. <br />NOW, THEREFORE BE IT ORDAINED BY THE COUNCIL OF THE CTTY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: <br />SECTION 1: That the City hereby accepts the easement from the owners of <br />property located at 4624 Lansing Drive being Permanent Parcel No. 232-02-006 and <br />which is more fully set out in Permanent Storm Sewer Easement, a copy of which said <br />easement is attached hereto, and made a part hereof, as though fully rewritten herein and <br />marked "Exhibit A." <br />SECTION 2: That all construction shall be accomplished as the sole cost and <br />expense of the City of North Olmsted. <br />SECTION 3: That the Engineer of the City of North Olmsted is hereby directed <br />to cause said easement to be recorded in the office of the Cuyahoga County Recorder. <br />SECTION 4: That this Ordinance is hereby declared to be an emergency measure <br />immediately necessary for the preservation of the public peace, property, health and safety <br />of the City, and further provided it receives the affirmative vote of two-thirds of all <br />members of Council, it shall take effect and be in force immediately upon its passage and <br />approval by the Mayor.
