:? .,. <br />CITY OF NORTH OLMSTED <br />ORDINANCE NO. 98- 71 <br />BY: COUNCII.MAN MICHAEL R GAREAU, JR <br />AN ORDINANCE ACCEPTING A STORM SEWER EASEMENT <br />LOCATED ON PROPER7Y OWNED BY RETAIL ?'ODAY- <br />N.OLMSTED, LIMITED AND DESIGNATED AS PERMANEIVT <br />PARCEL NO. 237-9-1 CUYAHOGA COUNTY MAPS AND <br />RECORDS, SAID EASF.MENT SHOWN ON EXHIBIT 'A'; AND <br />DECf.ARING ANEMERGENCY. <br />WHEREAS, the City has recommended that a portion of the open ditch on the southerly <br />portion of said property be improved by adding culverting and a headwall, and <br />WHEREA.S, Retail Today - N. Olmsted, Limited has agreed to pay all costs and eacpenses for <br />the culverting and headwall within the edsting drainage channel location, w?ith the new easement area <br />as shown on the plan of the proposed drainage system, which is attached to the proposed easement <br />agreement. <br />NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA .4ND STATE OF OHIO: <br />SECTION 1: That the City hereby accepts the easemern from the owners of property located at the <br />southeast corner of the Lorain Road and Clague Road intersection being Permanent Parcel No. 237- <br />9-1, and which is more fully set out in Permanent Storm Sewer Easement, a capy of which said <br />easement is attached hereto, and made a part hereof, as though fully rewritten herein and marked <br />"Exhibit A." <br />SEC770N 2: That the granting of the new easement and all construction shall be accomplished <br />as the sole cost and expense of Retail Today - N. Olmsted, Limited. <br />SE.CTION 3: That the Engineer of the City of North Olmsted is hereby directed to cause said <br />easement to be recorded in the office of the Cuyahoga County Recorder. <br />SECTION 4: That this Ordinance is hereby declazed to be an emergency measure immediaxely <br />necessary for the preservation of the public peace, property, health and safety of the City, and further <br />provided it receives the affirmative vote of two-thirds of all members of Council, it sha11 take effect <br />and be in force immediately upon its passage and appoval by the Mayor. <br />
