<br />CITY OF NORTH OLMSTED <br />ORDINANCE NO. 98-55 <br />BY: COUNCILMAN THOMAS O'GRADY <br />AN ORDINANCE CREATING NEW AND REVISED SECTIONS 505.02 AND 505.08 <br />OF CHAPTER SOS OF 7HE GENERAL OFFENSES CODE ENTITLED "ANIMALS <br />& FOWL, " IN ORDER TO PROVIDE FOR 7HE IMPOUNDING OF ANIMALS <br />CAIISIIVG NUISANCES IN THE CITY OF NORTH OLMSTED, WHERE THEIR <br />OWNERS GANNOT BE I111MEDIATELYLOCATED, ASSESSING COSTS FOR THE <br />IMPOUNDIIVG AND %EEPIIVG OF SUCH ANIMALS, AND DECLARING AN <br />EMERGENCY. <br />WHEREA.S, it has l?.m brought to the attention of this Council that present Section 505.02 <br />of the Codified Ordinances only pernuts the animal warden to assess impound costs against the <br />owners, keepers and harborers of dogs; and <br />WHEREAS, this Council believes that authorizing the animal warden to assess impound <br />costs against the owners, keepers and harborers of any animal which is lawfully seized by the <br />animal wazden is responsible and fair to the taxpayers of the City; and <br />WHEREAS, this Council further believes that expanding the impound authority of the <br />animal warden to include all animals who are both causing a nuisance, as that term is defined in <br />Section 505.08 of the Codified Ordinances, and whose owners, keepers or harborers cannot be <br />immediately located, will promote the public health, safety, and welfare of the City; and <br />WHERF.AS, this Council accordingly desires to enact new and revised Sections 505.02 and <br />505.08 of the Codified Ordinances to accomplish the foregoing; <br />NOW, THEREFORE, BE IT ORDAINED BY 7HE COUNCIL OF 7HE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: <br />SECTION 1: That there be and hereby is created new and revised Sections 505.02 and <br />505.08 of Chapter 505 of the General Offenses Code. Said new and revised sections shall be entitled <br />and in their entirety shall read as follows: <br />"505.02 IlVIPOUNDING AND DISPOSITION. <br />(a) A police officer or animal warden may impound every animal found in violation of <br />Section 505.01 or 505.08(e). If the animal impounded is not wearing a valid registration tag and the <br />owner, keeper or harborer cannot otherwise be reasonably determined immediately, notice shall be <br />posted in the pound or animal shelter both describing the animal and place where seized, and advising <br />- xm?en-m•?-? . „?z«?snr, .... . .. .. _.. w?.+:t++w"r? .,? ??,'r?R.';a??
