? <br />a, <br />CITY OF NORTH OLMSTED <br />ORDINANCE NO. 98-17 <br />BY: MAYOR NORMAN MUSIAL <br />AN ORDINANCE CREAT12VG NEA'SECTION 505 .13 OF CHAPTER SOS OF THE <br />GENERAZ OFFENSES CQDES ENTITLED "ANIMALS & FOWL" TO REQUIRE <br />RABIES VACCINATION OF CATS AND DOGS, AND PROVIDE CRIMINAL <br />PENALTIES AGAINST PET OWNERS WHO FAIL TO COMFLY, AS AMENDED. <br />WHEREAS, Council desires to supplement Chapter 505 entitled "ANIMALS & FOWL" by <br />enacting new Section 505.13 entitled "RABIES VACCINATION OF DOGS AND CATS <br />REQUIRED. 11 <br />NOW, THEREI4'ORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: <br />SECT7ON1: That Council hereby supplements Chapter 505 entitled "A?NIMALS & FOWL" <br />of the General Offenses Code by creating new Section 505.13 entitled "RABIES VACCINATION <br />OF DOGS AND CATS REQUIItED," which as enacted shall read as follows: <br />"505.13 RABIES VACCINATION OF DOGS AND CATS REQUIRED. <br />(a) Any person owning, keeping or harboring any dog or cat over the age of six (6) <br />months shall be required to have such animal currently immunized against rabies by <br />a licensed veterinarian. <br />(b) All owners or keepers as described in part (a) of this Section shall maintain a record <br />of such immunization as provided by a veterinarian. They sha11 provide said proof of <br />immunization to any person so inquiring. <br />(c) Whoever violates Section (a) of this Ordinance is guilty of a misdemeanor of the <br />fourth degree. Whoever violates Section (b) of this Ordinance is guilty of a minor <br />misdemeanor, punishment shall be provided in Section 501.99 <br />SECTION 2: That any ordinance or parts of any Ordinances in conflict herewith are <br />hereby repealed. <br />SECTION 3. That it is found and determined that all formal actions of this Council <br />concerning and relating to this le,gislation was adapted in an open meeting of this Council and that <br />all deliberations of this Council and of any of its Committees that resulted in such formal action <br />were in meetings apen to the public in compliance with all legal requirements, including Section <br />1, Article XV of the Charter of the City of North Olmsted. <br />SECTION 4. 1'hat this legislation is hereby declared to be an emergency measure <br />immediately necessary for the preservation of the public health, safety and welfare, and for the <br />further reason that it is immediately necessary to insure cats and dogs within the City aze properly <br />?., . . ;v..,. _. ,. ?.< .. ? {,
