? }. <br />CONDITIONS OF AGREEMENT <br />SCOPE OF PROJECT The Engineer shall provide engineering services, as required <br />using ordinary engineering practices. The parties have agreed that the completion period <br />shall be twelve (12) months after the written authorization to proceed is issued by the <br />City. <br />COMPENSATION <br />A. The City shall compensate the Engineer for its services as provided in the proposal <br />dated February 9, 1998 (such proposal is attached hereto marked "Exhibit A" and <br />incorporated herein) provided, however that the total amount paid to the Engineer <br />shall not exceed $32,593.00. Payment shall be made for the work described in <br />Section 1 on a monthly basis based on the actual work completed during the <br />previous month. <br />B. In the event the period exceeds twelve (12) months and the extended period <br />requires the expenditure of additional work hours, the amount of the charges shall <br />be agreed upon by the Engineer and the City's Director of Public Service. <br />CONSULTANTS It is understood and agreed that the employment of any Consultant the <br />Engineer deems necessary to perform the work shall be contracted by the Engineer only <br />after written approvai of such consuitant by the City and shall be paid for by the Engineer. <br />4. ASSIGNMENT This Agreement shall not be assigned by the Engineer without the <br />written consent of the City. <br />Page 2 of 6
