CITY OF 111ORTH 0124STED <br />ORDINANCE N0. 90- 171 <br />BY: MAYOR BOYLE <br />AN ORDINANCE CREATING NEW SECTION 521.13 OF 'II3E CITY OF NORTH OLMSTED <br />CODIFIID ORDINANCFS ENTITLED, "TREEI,AWN AND APRON MAINTENANCE", AND <br />DECLARING AN IlKERGIIVCY. <br />WHEREAS, the deficient maintenance of treelawns and driveway aprons at various <br />locations within the City of North Olmsted poses a hazard and risk of injury to the <br />public; and <br />WHEREAS, said deficient maintenance may also adversely affect the appearance of <br />the City and diminish the enjoyment and comfort of the residents of the City. <br />NOW, TTHEREFORE, BE IT ORDAINED BY THE CITY OF N0RTH OIdASTED, COUNTY OF C[JYAHOGA, <br />AND STATE OF OHIO: <br />SECTION 1: That there be, and hereby is, enacted new Section 521.13 of the City <br />of North Olmsted Codified Ordinances, entitled, "Treelawn and Apron Maintenance", <br />which, as enacted, shall read in its entirety as follows: <br />"521.13 TREELAWN AND APRON r1AINTENANCE <br />(a) No owner or occupant of abutting lands shall fail to keep the <br />treelawn and driveway apron in repair and free from litter, <br />trash, debris or any other rruisance or hazard. <br />(b) Whoever violates this section is guilty of a minor misdemeanor." <br />SECTION 2: That this Ordinance is lereby declared to be an emergency measure <br />immediately necessary for the preservation of the public health, safety and welfare, <br />and for the further reason that it is immediately necessary to enact this legislation <br />to tne limit the risk of hazard and injury to the public caused by the deficient <br />maintenance of treelawns and driveway aprons within the City and further, provided <br />it receives the affirmative vote of two-thirds of all members elected to Council, it <br />shall take effect and be in force immediately upon its passage and approval by the <br />Mayor. <br />PASSED: <br />? <br />, <br />, <br />ATTEST: t4_?-?.. ?`` • ?`y.? ? ? / , ,? y ., , ? ,J 1 .; '? ,? ? ? <br />) <br />Clerk of Council President of Council <br />APPROVED : <br />First Reading: Second Reading: <br />?.?
