. ? <br />?.T + ' ...r `"rri. <br />Nothing contained in this section shall be construed so as <br />to prohibit the Mayor from serving as a member or official of any <br />organization of governments, special unit of government or an <br />organization of governmental officials, whether such organization <br />or special unit of government is organized as a special district, <br />regional council of governments, nonprofit corporation or some <br />other form under the statutes or Constitution of the State of Ohio <br />or the federal government. This section shall not prohibit the <br />Mayor from serving as a member or an official in any other non- <br />profit corporation where the Mayor's service is in the capacity of <br />representing the City. When serving as a member or an official or <br />anq organization of governments, special unit of government or an <br />organization of governmental officials, or where the Mayorts <br />service is as a member or official of a nonprofit corporation <br />permitted by this section, the Mayor shall not be deemed to be <br />interested in the profits or emoluments of any contract, job, work <br />or service for the city or other transaction because of any con- <br />tract or other transaction between the Citp and such organiza- <br />tions, special unit of government or nonprofit corporation; and <br />the Mayor may fully participate (i) as the Mayor of the City in <br />the deliberations by the City or its agencies and (ii) in his <br />capacity as a member or an official of such organization of gov- <br />ernments, special unit of government, organization of governmental <br />officials or nonprofit corporation, including the right to vote <br />with respect to such contract, job, work, service or other trans- <br />action. <br />SECTION 2: That if such amendment is approved bq a majoritp of the <br />electors voting thereon at such election, it shall become effective from <br />and after the time of its approval by the electors. <br />SECTION 3: That the Clerk of Council is hereby authorized and direct- <br />ed to cause a copy of the proposed Charter Amendment to be published in <br />such manner as may be authorized by law. <br />SECTION 4: That the Clerk of this Council be and she is hereby au- <br />thorized and directed to forward a certified copy of this Ordinance to the <br />Board of Election of Cuyahoga County. <br />SECTION 5: That the Board of Elections is herebp requested to cause <br />appropriate notice of such election to be duly given in accordance with <br />law. <br />SECTION 6: That this Ordinance is hereby declared to be an emergency <br />measure immediately necessary for the preservation of the public health, <br />safety and welfare, and for the further reason that it is immediatelp <br />necessary to enact this legislation so that this issue may be submitted to <br />the electors in time for the November 6, 1990 General Election, and fur- <br />ther, provided it receives the affirmative vote of two-thirds of all mem- <br />bers elected to Council, it shall take effect and be in force immediately <br />2
