<br />measures, and shall at all times keep the Council fully advised as <br />to the financial condition and needs of the City. He shall cause <br />all terms and conditions imposed in favor of the City or its inhab- <br />itants in any franchise or contract to which the City is a party to <br />be faithfully kept and performed. <br />Except as may otherwise be provided by this Charter or the laws of <br />the State of Ohio governing Civil Service, the Mayor shall have the <br />power to appoint, promote, transfer, reduce or remove any officer <br />or employee of the City except (a), those required by this Charter <br />to be elected, and (b), those whose terms of office may be fixed by <br />this Charter. The appointment of every officer and employee ap- <br />pointed by the Mayor shall, unless otherwise provided in this <br />Charter, automatically terminate at the earlier of (1) the end of <br />the term of office of the Mayor making the appointment, or (2) the <br />date upon which the Mayor makinq the appointment leaves office by <br />death, resignation or other reason creating a vacancy in the office <br />of Mayor. Unless otherwise provided for in this Charter, the Mayor <br />may during his term, without concurrence of Council, remove any <br />officer or employee whom he has appointed provided, however, that <br />heads of departments or divisions created by this Charter may only <br />be removed with the concurrence of two-thirds (2/3) of the members <br />of Council eligible to vote. <br />The Mayor shall execute on behalf of the City, all contracts, <br />conveyances, evidences of indebtedness, and all other instruments <br />to which the City is a party. He shall have custody of the seal of <br />the City and may affix it to all of said instruments, but the <br />absence of the seal shall not affect the validity of any such <br />instrument. The Mayor shall be recognized as the official and <br />ceremonial head of the City government by the Governor for military <br />purposes and by the courts for the purpose of serving civil proc- <br />esses. <br />SECTION 2: That if such amendment is approved by a majority of the <br />electors votinq thereon at such election, it shall become effective from and <br />after the time of its approvaT by the electors. <br />SECTION 3: That the Clerk of Council is hereby authorized and directed <br />to cause a copy of the proposed Charter Amendment to be published in such <br />manner as may be authorized by law. <br />SECTION 4: That the Clerk of this Council be and she is hereby <br />authorized and directed to forward a certified copy of this Ordinance to the <br />Board of Elections of Cuyahoga County. <br />SECTION 5: That the Board of Elections is hereby requested to cause <br />appropriate notice of such election to be duly given in accordance with law.
