AND DECLARING AN <br />ENIIItGENCY. <br />WHEREAS, Hennie Homes, Inc. desires to extend a water main into their <br />property for the Cinnamon Woods Development, and <br />WffiERFAS, the City of Cleveland requires that extension of water lines shall <br />only be approved if easements are granted to both the City of Cleveland and <br />the City of North Olmsted in order that water mains ma.y be constructed and <br />maintained therein, and <br />WHEREAS, this Council deems it in the best interest of the City to accept <br />the water main easement described herein; attached Exhibit "B". <br />NOW, THEREFORE, BE IT ORDAINED BY 7HE COUNCIL OF THE CITY OF NOR7EI <br />OLM..STED, COUN'I'Y OF CUYAHOGA, AND STATE OF OHIO: <br />SECTION 1: That this Council does hereby accepts an easement from Hennie <br />Homes Inc. for the installation and maintenance of a water main for the purpose <br />of supplying water service by the City of Cleveland, to the property of Hennie <br />Homes, Inc. <br />SECTION 2: That the Clerk of this Council is hereby authorized to forward <br />a certified copy of this Ordinance to the Director of Public Utilities of the <br />City of Cleveland. <br />SECTION 3: That it is found and determined that a11 formal actions of this <br />Council concerning and relati.ng to the adoption of this Ordinance were adopted <br />in an open meeting of this Council, and that all deliberations of this Council, <br />and of its comanittees that resulted in such formal action, were in meetings open <br />to the public in compliance with all legal requirements, including Section <br />121.22 of the Ohio Revised Code. <br />SECTION 4: That this Ordinance is hereby declared to be an emergency <br />measure immediately necessary for the preservation of the public health, safety <br />and welfare, and further provide it receives the affirmative vote of two-thirds <br />of all members of Council, it shall take effect and be in force immediately upon <br />its passage and approval by the Mayor. <br />• ';
