. ? <br />?-xhibit "B <br />?- <br />YOL. 92-11271 PAGE 21 <br />TIIKPORARY CONSTRUCTION EASIIMIIVT AND PERMANENT MAINTEIVANCE EASEhiIIVT <br />FOR TRAFFIC CONTROL EQUIPMIIVT ON LAND CONVEYID TO MANNERS INVES'IlKENT <br />LIMITID PARTNERSHIP <br />This easement, granted this day of QcA 1j-*^ 1992, by <br />Manners Investment Limited Partnership, hereinafter called "Grantor", <br />26770 Lorain Road, North Olmsted, Ohio, 44070 to the City of North <br />Olmsted, hereinafter called "Grantee", 5200 Dover Center Road, North <br />Olmsted, Ohio 44070. <br />WITNESSETH: <br />That Grantor, for and in consideration of the mutual premises and <br />covenants herein, and other good consideration, does hereby give, grant, <br />'convey, and release to the said Grantee, or its duly authorized agents <br />or contractors, permission to enter upon its land defined by County fit <br />Auditor as Permanent Parcel 232-26-3 and use that partlas shown in <br />Exhibit "A" attached hereto for the following: labeled "Easement Area" and <br />measuring approximately 261X33' <br />TIIKPORARY CONSTRUCTION EASIIKIIQ'T <br />1. During the period beginning with the breaking of ground for the <br />installation of the traffic control equipment and terminating <br />when the work has been fully accepted by the City of North <br />Olmsted. <br />2. Such use of the easement are defined in Exhibit "A" shall be <br />limited to installation of traffic control equipment in <br />connection with the installation of a traffic signal at Lorain <br />Road and Country Club Boulevard adjoining the Grantor's <br />property boundary. Grantee shall restore area to original <br />condition. <br />PERMANENT MAINTENANCE EASIlMIIVT <br />1. Perpetual right to enter upon and use said part of its <br />land for the ma.intenance of traffic control equipment. <br />2. Such use of the easement area defined in Exhibit "A" shall <br />be limited to the maintenance of the traffic control equipment <br />for the traffic signal located at Lorain Road and Country Club <br />Boulevard adjoining the Grantor's property boundary. Grantee <br />shall restore area to original condition. <br />Grantor reserves unto itself all use of the subject premises to the <br />extent that they are not inconsistent with the rights conferred herein. <br />Grantor does hereby covenant with the said Grantee that at and <br />until the sealing of these presents, Grantor is well seized of the above <br />described Premises and has a good and indefensible estate in FEE SIMPLE <br />and has good right to bargain and grant the same in manner and form as <br />above written.
