_... _.a?,,. . ? _ a . .. <br />_ ?. ,...a,..?,,? .?.? .. ,. ? . _ . .._ . . <br />? <br />11? , . <br />CITY OF NORTH OLMSTID <br />ORDINANCE N0. 92 -135 <br />BY; Councilman Dean McKay <br />AN ORDINANCE AUTfiORIZING THE DIRECTOR OF PUBLIC SERVICE TO <br />MAKF ENIIItGEDTTCY REPAIRS ON THE NATURAL GAS LINES AT THE <br />WASTEWATER TREAD= FLANT, WITHOUT PUBLIC BIDDING, AND <br />DECLARING AN IIMERGINCY. <br />WHEREAS, recent inspection by the East Ohio Gas Company and the <br />City of North Olmsted, of the gas lines at the Wastewater Treatment <br />Plant has indicated that the gas lines are in immediate need of <br />replacement and/or repair. <br />WI-EREAS, the aforesaid problem has reached such a critical state <br />that public bidding and the time associated therewith would be too time <br />consuming to meet the City's obligation to protect the public health, <br />safety and welfare; and <br />WHEREAS, as a result thereof, the City Engineer, has developed <br />plans, specification and cost estimates to accomplish the aforesaid <br />repair. <br />WHEREAS, upon the recommendation of the City Engineer, this Council <br />deems it an emergency sufficient in magnitude to forego public bidding <br />on said project in order to protect the public health, safety and <br />welfare of the resident of the City. <br />NOW, nMREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH <br />OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: <br />SECTION 1: That the Director of Public Service be and he is hereby <br />authorized to solicit proposals froan at least two contractors qualified <br />to perform the work outlined by the plans and specifications prepared by <br />the City Engineer, and that after having obtained same, the Director of <br />Public Service present said proposals to the Board of Control for its <br />approval. In any event, the cost for said repair shall not exceed <br />Seventy Thousand Dollars (70,000). Upon Approval by the Board of <br />Control, the Ma.yor be and he is hereby authorized and directed to enter <br />into a contract for same. <br />SECTION 2: That Ordinance Number 92-123 is hereby repealed.
