. ,?..? ??.?.?..., ?...._1,? <br />..n.. <br />CITY OF NORTH OLMSTED <br />RESOLUTION N0. 92-131 <br />BY: COUNCILMAN NASHAR <br /> <br />A RESOIUTION R?QUESTIlJG 7Z3E CUYAXGA COUNl'Y ENGINEER TO PROCEm <br />WITH 7HB IlMP'ROVIIMENT OF CROCKER-STFAM (CR-118) ANID TO INCLUDE <br />A MINIlMM OF SIX FtXyT ffiGII WOOD FFNCE AIANG 7HE RIQT-0F-WAY T,TNF <br />TO PRO'TE(.'r THE RESIDIINTIAL PROPIItTY Off AAM"M DRIVE ANID QiTAII, <br />RUN, AND RFSOLVIlM 7.'0 PAY FOR CIItTlLIIN ITFMS AND FLAN QiA1?iGFS31 AS <br />AMIDMID. <br />WfEREAS, the proposed improvement of Crocker-Stearns (CR-118) Extension is <br />being financed by the Federal Government and Cuyahoga County; and <br />WHIItEAS, an executed Agreement between the Board of County Commissioners <br />and the City of North Olmsted states that if the MUNICIPALITY formally requests <br />to include items in the improvement that are in addition to those now existing, <br />and not provided for elsewhere, that the MUNICIPALITY agrees to pay the non- <br />Federal share of the costs. <br />WHEREAS, the City of North Olmsted would like to include items in the <br />improvement that are in addition to those now existing and not provided for <br />elsewhere. <br />NOW, 'IIiEREFORE, BE IT RESOLVED by the Council of said City of North <br />Olmsted, State of Ohio: <br />Section 1: That the Cuyahoga County Engineer is hereby requested to <br />include a minimm of six foot high wood fence along the right-of-way line on <br />Hampton Drive and Quail Run. <br />Section 2: That the City of North Olmsted agrees to assume the non-Federal <br />share of the cost of any expenses incurred by the Cuyahoga County Engineer for <br />the installation of a minimum of six foot high wood fence along the right-of-way <br />line on Hampton Drive and Quail Run. <br />Section 3: That this resolution is hereby declared to be an emergency <br />measure necessary for the immediate preservation of the public peace, health and <br />safety. Such necessity exists by reason of the fact that in order for plans for <br />the improvement of the Crocker-Stearns Extension to be approved by the State of <br />Ohio and said project bid, the request to include items which are not provided <br />for elsewhere in the agreement, must be immediately made; and <br />Section 4: That it is found and determined that a11 formal actions of this <br />Council concerning and relating to the adoption of this Resolution were adopted <br />in an open meeting of this Council, and that a11 deliberations of this Council <br />and of any of its committees tha.t resulted in such formal actions were in <br />meetings open to the public, in compliance with all legal requirements, <br />including Section 121.22 of the Ohio Revised Code.
