WfEREAS, the proposed improvement of Crocker-Stearns (CR-118) Extension is being financed by the Federal Government and Cuyahoga County; and WHIItEAS, an executed Agreement between the Board of County Commissioners and the City of North Olmsted states that if the MUNICIPALITY formally requests to include items in the improvement that are in addition to those now existing, and not provided for elsewhere, that the MUNICIPALITY agrees to pay the non- Federal share of the costs. WHEREAS, the City of North Olmsted would like to include items in the improvement that are in addition to those now existing and not provided for elsewhere. NOW, 'IIiEREFORE, BE IT RESOLVED by the Council of said City of North Olmsted, State of Ohio: Section 1: That the Cuyahoga County Engineer is hereby requested to include a minimm of six foot high wood fence along the right-of-way line on Hampton Drive and Quail Run. Section 2: That the City of North Olmsted agrees to assume the non-Federal share of the cost of any expenses incurred by the Cuyahoga County Engineer for the installation of a minimum of six foot high wood fence along the right-of-way line on Hampton Drive and Quail Run. Section 3: That this resolution is hereby declared to be an emergency measure necessary for the immediate preservation of the public peace, health and safety. Such necessity exists by reason of the fact that in order for plans for the improvement of the Crocker-Stearns Extension to be approved by the State of Ohio and said project bid, the request to include items which are not provided for elsewhere in the agreement, must be immediately made; and Section 4: That it is found and determined that a11 formal actions of this Council concerning and relating to the adoption of this Resolution were adopted in an open meeting of this Council, and that a11 deliberations of this Council and of any of its committees tha.t resulted in such formal actions were in meetings open to the public, in compliance with all legal requirements, including Section 121.22 of the Ohio Revised Code.
