NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: SECTION 1: That it is hereby resolved that the City of North Olmsted accepts title to the 3.38750 acres of real property in the Deerf'ield North Subdivision, formerly used as the recreational azea for the Deerfield North Home Owners Association, including the pool and all other structures located upon the property, and which real property is legally described as follows: Situated in the City of North Olmsted, County of Cuyahoga and State of Ohio and being known as part of Original Dover Township Lot No. 29 and bounded and described as follows: Beginning at a stone in the centerline of Gessner Road (60 feet wide), said stone being the Southeasterly corner of Original Dover Township Lot No. 29; Thence South 89 degrees 17' 25" West along the centerline of Gessner Road a distance of 1321.54 feet to an iron pin; Thence North 0 degrees 06' 40" East a distance of 463.16 feet to a point and the principal place of beginning; Thence continuing North 0 degrees 06' 40" east a distance of 181.96 feet to a point; Thence North 89 degrees 14' 27" East a distance of 617.89 feet to a point; Thence South 0 degrees 45' 33" East a distance of 408.09 feet to a point; Thence South 89 degrees 19' 11" West a distance of 155.65 feet to a point; Thence North 0 degrees 06' 40" East a distance of 225.57 feet to a point; Thence South 89 degrees 17' 25" West a distance of 468.43 feet to the principal place of beginning. Containing 3.38750 acres of land according to a survey made by Alexander Kanareff, Registered Surveyor, No. 4446. upon the sole condition that the City may use the real property for any lawful use whatsoever, may freely convey said real property to any third party, and shall not be bound by the conditions of the deed conveying said property to the Deerfield North Home Owners Association, Inc.
