CITY OF NORTH OLMSTED <br />ORDINANCE N0. 92-123 <br />BY: Councilman McKay <br />AN ORDINANCE AUTHORIZING THE DIRECTOR OF PUBLIC SERVICE TO <br />MMAKE IIMERGENCY REPAIRS ON 'IHE NATURAL GAS LINES AT TBE <br />WASTEWATER TREATMIIVT PLANT, WITHOUT PUBLIC BIDDING, AND <br />DECLARING AN IIMERGENCY. <br />WfiEREAS, recent inspection by the East Ohio Gas Conpany and the City of <br />North Olmsted, of the gas lines at the Wastewater Treatment Plant has indicated <br />that the ga.s lines are in immediate need of replacerient and/or repair. <br />WHEREAS, the aforesaid problem has reached such a critical state that public <br />bidding and the ti.me associated therewith would be too time consuming to meet the <br />City's obligation to protect the public health, safety and welfare: and <br />LMREAS, as a result- thereof, the City Engineer has developed plans, <br />specifications and cost est'unates to accomplish the aforesaid repair. <br />WHEREAS, upon the recommendation of the City Engineer, this Council deeris it <br />an emergency sufficient in magmitude to forego public bidding on said project in <br />order to protect the public health, safety and welfare of the residents of the <br />City. <br />NOW, THEREFORE, BE IT ORDAINED BY 'IIiE COUNCIL OF THE CITY OF NORTH OLMSTED, <br />COUN7.'Y OF CUYAHOGA AND STATE OF OHIO: <br />SECTION 1: That the Director of Public Service be and he is hereby <br />authorized to solicit proposals frm at least two contractors qualified to <br />perform the work autlined by the plans and specifications prepared by the City <br />Engineer, and that after having obtained same, the Director of Public Service <br />present sa.id proposals to the Board of Control for its approval. In any event, <br />the cost for said repair shall not exceed Fifty Thousand Dollars ($50,000). <br />Upon approval by the Board of Control, the Mayor be and he is hereby authorized <br />and directed to enter into a contract for sarie. <br />SECTION 2: That this ordinance is hereby declared to be an emergency <br />measure necessary for the preservation of the public health, safety and welfare, <br />and for the further reason that it is immediately necessary to protect the <br />residents and further provided it received the affirmative vote of two thirds of <br />all members of Council, it shall go into inunediate force and effect upon its <br />signing by the Ma.yor. <br />PASSED: <br />ATTES . <br />+-s?- <br />B ARA L.
