<br />CITY OF NOR7?i OLMSTED <br />ORDINANCE 92-109 <br />BY: COUNCILMAN LIND <br />11^?. <br />AN ORDINANCE AUTHORIZING gIEE SALE OF SURPLUS PERSONAL PROPERTY <br />OWNID BY 'IIBE CITY OF NORTH OLMSTID AND PREVIOUSLY USED BY THE <br />DEPARDIENT OF PUBLIC SERVICE ATv'D DEPARTr1IINTT OF PUBLIC SAFETY, <br />ANID DECLARING AN ENEItG121CY. <br />WHEREAS, the Council and the Administration have deterriined that various <br />items of personal property owned by the City of North Olmsted and forr,ierly used <br />by the Department of Public Service are no longer needed for municipal purposes, <br />and, <br />WHEREAS, it is the desire of this Council to sell and or trade for goods of <br />equal or greater value, said personal property in accordance with the law. <br />NOW, THEREFORE BE IT ORDAINED BY THE COUNCIL OF TEiE CITY OF NORTH OLMSTED, <br />COUNTY OF CUYAHOGA AND STATE OF OHIO: <br />SECTION l: That the following personal property was formerly used by the <br />Department of Public Service and Department of Public Safety, and is no longer <br />needed for mun.icipal business, to wit: <br />(See attached Schedule "A" made a part hereof as though fully re-written <br />herein.) <br />SECTION 2: That the Mayor be and he is hereby authorized to sell sa.id <br />personal property to the highest bidder according to law, provided however, that <br />the highest bid is approved by the Board of Control and further provided that the <br />highest bidder shall, upon acceptance of the bid, pay to the Director of Finance <br />of the City of North Olmsted, twenty-five percent (25%) of the bid price and that <br />within five (5) days thereafter, the entire bid price shall be paid and the <br />successful bidder shall accept and remove said property from the premises of the <br />city. The Tlayor, having been advised upon receipt of the full bid price shall, <br />if necessary, execute any and all documents required by law. <br />SECTION 3: That this ordinance is hereby declared to be an emergency <br />measure immediately necessary for the preservation of the public health, safety <br />and welfare and for the further reason that the sale of surplus equipnent is <br />necessary to protect the value thereof for resale purposes.
