. 0 <br /> <br />(b) If subsection (a) hereof is satisfied, all new construction and substantial improvements <br />sha11 comply with a11 applicable flood hazard reduction provisions of Section 1361.08. <br />1361.99 PENALTY. <br />Violation of the provisions of this chapter or failure to comply with any of its <br />requirements sha11 constitute a misdemeanor of the first degree. Whoever violates any provision <br />of this chapter or fails to comply with any of its requirements (including violations of conditions <br />of and safeguards established in connection with conditions) shall be fined or imprisoned as <br />provided by the laws of the City. Each day such violation continues shall be considered a <br />separate offense. Nothing herein contained shall prevent the City from taking such other lawful <br />action as is necessary to prevent or remedy any violations. <br />SECTION 2• That any other ordinance or parts of ordinances heretofore adopted that <br />are inconsistent herewith are hereby repealed. <br />SECTION 3: That this Ordinance is hereby declared to be an emergency measure <br />immediately necessary for the preservation of the public health, safety and welfare, and for the <br />further reason that it is immediately necessary to establish updated and revised regulations <br />dealing with flood control and further provided it receives the affirmative vote of two-thirds of <br />a11 members of Council, it shall take effect and be in force immediately upon its passage and <br />approval by the Mayor. <br />PASSED: <br />A , T: <br />? <br />ARBARA L.
