r <br />CITY OF NORTH OLMSTED <br />ORDINANCE NO. 92- 44 <br />BY: MAYOR EDWARD BOYLE <br />AN ORDINANCE AUTHORIZING AND DIRECTING THE <br />DIRECTOR OF LAW OF THE CITY OF NORTH OLMSTED <br />TO PREPARE AND FILE WITH THE COURT OF COMMON <br />PLEAS OF CUYAHOGA COUNTY, OHIO, A REVISED AND <br />MODIFIED JUDGMENT ENTRY IN THE CASE OF <br />DEVELOPERS DIVERSIFIED, ET. AL. VS. THE CITY OF <br />NORTH OLMSTED, ET. AL., CASE NUMBER 127076, AND <br />DECLARING AN EMERGENCY. <br />WHEREAS, the City of North Olmsted in Case Number 127076 styled Developers <br />Diversified, et. al. vs. City of North Olmsted reached an agreement with the Plaintiffs to impose <br />certain zoning uses on property owned by the Plaintiff which is more fully set out on the map <br />which is attached hereto and made a part hereof and marked Exhibit "A"; and <br />WHEREAS. Parcel B is currently being developed for multi-family as provided for in <br />said judgment entry; and <br />WHEREAS, the Plaintiff, together with the City has negotiated with Moen Incorporated <br />to relocate their national headquarters consisting of corporate offices to the City of North <br />Olmsted which office building is to be located on Pazcels C and D which is more fully <br />delineated on the attached Exhibit "A"; and <br />WHEREAS, this Council recognizes that Pazcel C, by virtue of the judgment entry, was <br />to be utilized for the construction of either an office or hotel and Parcel D was delineated to be <br />used for a full service hotel; and <br />WHEREAS, after negotiating with both the Plaintiff and Moen Incorporated regarding <br />the construction of the national office headquarters of Moen Incorporated in North Olmsted on <br />Parcels C and D, it is the opinion of this Council that it is appropriate to modify the aforesaid <br />judgment entry to reflect therein the city's agreement to permit the change of uses consistent <br />with this ordinance. <br />NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, CUYAHOGA COUNTY AND STATE OF OHIO: <br />SECTION 1: That the Director of Law for the City of North Olmsted be and he is <br />hereby authorized and directed to modify, on behalf of the city, the aforesaid judgment entry to
