' <br /> <br />g?J L" 2? 21 <br />Vi?!.. 92-5544 PAGE 35 <br />DECLARATION OF RESTRICTIONS <br />THIS DECLARATION OF RESTRICTIONS is made by SHOREWEST <br />CONSTRUCTION COMPANY, the "Declarant". <br />WITNESSETH <br />C? <br />? <br />... ??? <br />t <br />WHEREAS, Declarant is the owner of the real property located in the City of North <br />Olmsted, Ohio, and more fully described in Exhibits "A" and "B" attached hereto and made a <br />part hereof (hereinafter referred to as "Property A" and "Property B" respectively); and <br />WHEREAS, Declarant has applied to the City of North Olmsted to rezone Properties A <br />and B from one and two family residence district use classification to single family cluster <br />district classification; and <br />WHEREAS, Declazant has further submitted to the City plans which ?Rropose to develop <br />Property B for single family cluster use and to maintain Property A asQ??o??course; and <br />WHEREAS, the City's Planning Commission has recommended approval of said <br />development plans and rezoning request with, inter alia, the condition that, in order to satisfy <br />the density requirements for the single family cluster development on Property B, the Declarant <br />should be required to maintain Property A as a golf course or green area; and <br />WHEREAS, Declarant accordingly wishes, for the benefit of the City of North Olmsted <br />ana surrouilding aiict aouttitig landowiiers, inciuaing ihe landowriers and residents, now aild in <br />the future, of Property B, to restrict the use and provide for the maintenance of Property A in <br />accordance with the terms and conditions set forth herein. <br />NOW, THEREFORE, Declarant, as owner of Properties A and B, for itself, its <br />successors and assigns, declares as follows: <br />i 1. That Property A sha11 be used solely and exclusively as a golf course. Further, in <br />, ?no event sha11 Property A be utilized for any other use otherwise permitted in the zoning district <br />or under the zoning classification within which the Property is presently located, or in which <br />it may be located at any time in the future.
