Any fax, fee or _ asse . <br />such tax, fee or assessment imposed on hoth utilities, system <br />operators, cable operators or their services but not inciuding a tax, <br />fee or assessment which is unduly discriminafory against Cable <br />Operators or cable Subscribers); <br />2. In the case of this franchise, any and all costs or payment of any <br />sort or description which shall be paid by the GRANTEE in support <br />of the use of Peg Access Channels, Peg Access programming, <br />Peg Access Equipment, educational or govemmental access <br />and services and equipment required by this Agreement. <br />3. Charges, payment of any sort or description which are incidental <br />to, and pertaining to the awarding and or enforcing the terms and <br />conditions of the franchise, including but not limited to charges or <br />payments made by the GRANTEE for bonds, letters of credit, <br />insurance, indemnification penalties, liquidated damages, <br />attorney fees, judgements or any fee imposed under title 17, United <br />States Code or the acceptance fee as required by Section XXXII, <br />or funds expended therefrom. <br />SECTION XVIII: <br />RECORDS, REPORTS AND FILINGS <br />A. The GRANTEE shall keep and maintain complete and accurate books of <br />account and records of its business and operations under and in connection with the <br />terms of this Agreement. _ <br />? <br />B. The Mayor or his or her authorized agent shall have access to all books <br />of account and records of the GRANTEE for the purpose of ascertaining the <br />correctness of any and afl reports and shall be given access to the aforementioned <br />records and books; along with access to any other books or records reasonably <br />deemed applicable to the enforcement of the agreement by the City. The GFZ4NTEE <br />shall provide such required access upon Reasonable Request, within a Reasonable <br />Time. <br />C. Upon request the GRANTEE shall provide the City with copies of all <br />petitions, applications and communications which the GRANTEE has submitted to the <br />Federal Communications Commission, Securities and Exchange Commission, or any <br />other Federal or State regulatory Commission or Agency having jurisdiction with <br />?S
